Dumb Lawsuit of the Day: Suing Over a Free Lunch

As you’ll recall, back in May, Kentucky Fried Chicken, er . . . KFC, was giving out free meals via internet coupons.  The promotion was a fiasco, with long lines and, ultimately, the retail restaurant chain canceling the promotion of its grilled chicken in favor of a mail in coupon (with staggered dates).

It was deserved bad publicity for a poorly planned marketing campaign that turned what could have been a lot of positive good will into angry customers galore.  However, KFC made good by mailing out the free coupons to those who filled out a form.

But that’s not good enough for Detroit resident Kay Ready and her lawyer Jay Edelson.  They’ve filed a federal class action lawsuit against KFC for fraud.  Read the entire absurd lawsuit complaint.

That’s ridiculous.  KFC made good  on the promotion, mailing out coupons for the meals it couldn’t handle during the time of the promotion, and the coupons even included something extra, a free drink.  Ms. Ready could have easily obtained the mailed coupons.  She and her lawyer are just driving up the price of KFC for the millions of American families who find it an economical choice in tough times.  And, of course, Mr. Edelson, clogging the courts with this waste of time, stands to make millions in legal fees.

KFCha-ching.

Remember them the next time prices at your favorite fast food restaurant go up.  It’s the involuntary litigation tax you’re paying for silly, frivolous  lawsuits like this one.

The next time someone says there’s no such thing as a free lunch, they are right after all.  If KFC offers the free lunch, some sleazy lawyer finds a way to make ’em pay.

These people are literally making a federal case over a $5 lunch.

My “beef” with KFC is they are selling “grilled chicken” when it isn’t. My understanding, because I haven’t eaten it yet, is the sear marks aren’t real. Plus they use “beef” products in their chicken. A big no-no. Apparently they are trying to compete in the grilled chicken market because of El Pollo Loco is just better chicken.

However the lawsuit alleges “millions of people were turned away by KFC, at times leading to violence.” Give me a break!! There should be a cease and disset ordr on KFC saying it is grilled but very, very minor compensation to lawyer. Any pay out should be a fine, not some dirtbag lawyer raking in money. How is society benefitted by lawyer getting his take in the millions?

I was already buying that new grilled KFC chicken…and it is great–I even had it for lunch (on the go) today.

As for the promotion…it was strange, I tried to get the coupon from the link you posted, and couldn’t get it to work. I referred the link to a couple friends and they got it to work–they were thanking me the office–and yes they got their free chicken. So, how do I join the class action? LOL

I love Deb and I despise most lawyers who aren’t her, but I think she dropped the ball here on a couple of points. The first is that we also all “pay” for “free” promotions, not just lawsuits. Second, I am sort of glad that someone is taking KFC to task because it *was* a poorly planned and executed promo. How many people wasted time, money and gas trying to get free, promised food and then be turned away because the store ran out or wasted time trying to follow fruitless links or crashing servers? Yes, individually, it’s not that bad, but collectively KFC caused a lot of hassle and enticed people into wasting their resources and KFC should be taken to task for it as a lesson to other corporations who might be tempted to follow suit. As far as the lawyers fees, I have no problem with that. A lawyer has to make a living and it’s not fair to expect him to spend years in education and effort and spend hundreds or thousands on labor, costs and fees for filing a class action suit, and then expect him to be paid in free chicken coupons or something.

The linked news article says “KFC…sent out letters to its stores telling them not to honor the offer.”

If they did that, then they are wrong and should be held responsible, but not responsible for paying lawyers millions of dollars.

I wouldn’t patronize KFC or McDonalds for FREE because they use HALAL. I won’t describe the method, but leave it to the muzzies to be as barbaric and cruel as possible IN ALL THINGS and for these companies to pander to these savages.
