Numbskull Immigration Judge: ICE Arrests of Illegal Aliens is “Retaliation,” Allows Them to Stay

If you are an illegal alien in Connecticut and you’re challenging your deportation in court, you hit the lottery if you draw Immigration Judge Michael W. Straus to hear your case. It’s a virtual golden ticket to remain in the Willy Wonka Chocolate Factory that is America . . . forever.
It’s bad enough that Homeland Security Secretary Janet Napolitano a/k/a “The Lesbionic Woman” stopped Immigration and Customs Enforcement (ICE) agents from doing their jobs and investigated them. Worse that the Supreme Court ruled ICE must prove an illegal alien’s knowledge that a fake ID is stolen. Now, in Judge Straus, immigration law enforcement agents have an even more liberal opponent to their efforts to enforce immigration laws.
Yesterday, he ruled that ICE agent raids on illegal aliens were improper because they were done in response to a New Haven program providing ID cards to illegal aliens. So, I guess ICE agents aren’t allowe to read the paper or watch the news and react accordingly in their plans to enforce the law. Nope. They must act in a vacuum. Anything less–any informed behavior–is now “illegal.”

The illegal aliens that ICE arrested all had deportation orders telling them to leave the country. Yet, they chose to continue to break the law and stay. But ICE arresting these people is now somehow illegal by the twisted logic that ICE was arresting these people in “retaliation” against the New Haven illegal alien IDs. So what? There’s nothing in immigration law or case law that says ICE can’t pick up illegal aliens (who were ordered to leave) in response to a city’s decision to enable them. This “retaliation” issue is a red herring. But not to left-wing Judge Straus.
It’s disgusting.
Moreover, the left-wing Yale sanctuary city nuts who run New Haven get to flout immigration laws and grant legal status to illegal aliens, but ICE can’t respond. Moreoever, lawyers from Yale represented the illegal aliens arrested for deportation by ICE. William F. Buckley should have changed the name of his book to “G-d and Illegal Alien at Yale.”

Judge Michael W. Straus of U.S. Immigration Court in Hartford threw out the cases against four immigrants swept up in the June 2007 Immigration and Customs Enforcement (ICE) raid. He ruled that government agents were in “egregious violation” of the immigrants’ Fourth Amendment rights.
For four individuals, the judge’s decisions marks an end to a two-year legal battle that began when Immigrations and Customs Enforcement (ICE) agents swept into Fair Haven, arresting 30 immigrants on charges of allegedly being in the country illegally. The raids prompted rallies and accusations from New Haven’s mayor on down that the feds were terrorizing the immigrant community and retaliating against the city for its immigrant-friendly policies, a charged the feds denied.
Attorneys from Yale Law School have been representing 17 of those 30 immigrants. The attorneys have argued that ICE agents violated their clients’ rights by entering their homes without permission and questioning them illegally. ICE has denied the allegations.
But Judge Straus agreed.
“In considering all the evidence in the record, this Court finds that the Respondent’s Fourth Amendment rights were egregiously violated,” he wrote.
PUH-LEEZE. Their Fourth Amendment rights were not violated. They had valid deportation orders against them, and ICE had the right to pick them up.
But, now, because of this case, they’re free to return back to their New Haven homes and will probably get rewarded with green cards and citizenship. That’s usually what happens when illegal aliens game the system. Our immigration process encourages that.
And that’s why our country will continue to die. We simply don’t have the guts to enforce our borders and regulate who comes in and who gets to stay.
As I always say, America . . . Desperate But Not Serious.
America has no intention of securing its borders or to cease being the world’s flophouse. All thanks to liberal judges like Michael W. Straus.
