Don’t worry about the charging of second degree murder rather than first. I believe that in New York State first degree murder is reserved for the murders of peace officers, witnesses to crimes, correctional officers, murders by inmates of prisons, murder for hire, the murders of judges, terrorism, extreme torture, and murders committed during the commissions of serious felonies.
Murder is a state crime, not a federal one, so the exact requirements are different from state to state. Beheading is not likely to be extreme torture which is usually charged when the torture occurs over a longer period and is part of the pathology of the crime. Second degree murder in NY is much like first degree murder in other states.
