Nadir of Slippery Slope?: Terrorist Padilla to See U.S. Secrets

Even though President BILL CLINTON, not George W. Bush, signed into law counterterrorism measures that made secret evidence against terrorists secret, the law is being nullified with no legal basis.
U.S. District Judge Marcia Cooke–the latest addition to our new novella “Stupid Judges & The Terrorists Who Love Them”–ruled that top-ranking Al-Qaeda official Abdullah Al-Muhajir a/k/a Jose Padilla (of dirty bomb fame) will get to see U.S. government secrets and secret evidence before his September trial on terrorism charges. Like Stephen Murphy, Cooke is another disastrous GEORGE W. BUSH nominee.
As we’ve written, Al-Muhajir/Padilla’s co-defendant, –who will also get to see this classified info–was a superintendent of Detroit and Washington, DC schools, in charge of water and air ducts–both of which he could have poisoned. Do we really want these kind of people ever getting their hands on our sources and methods? No, we don’t. But a stupid judge does. And decisions like these will be the death of our country.


Al-Qaeda’s Abdullah Al-Muhajir (“The Immigrant”) a/k/a Jose Padilla

One of the reasons cited is for the terror defendants’ lawyers to “refresh their memories” about what they told government interrogators. You know–so that they don’t change their story, lie, and get caught in front of a jury. We would never want to allow that to happen to Islamic terrorists, would we?
This is the latest slide down the slippery slope of what happens when you try terrorists in a justice system not designed for national security problems. Although the Supreme Court ruling in Hamdan v. Rumsfeld did not require that Al-Muhajir/Padilla and Jayyousi be allowed to see the secret evidence–nor did any other court ruling of note–this judge is obviously affected by it, in her ill-advised decision.
With judges and decisions like this, good luck winning the domestic war on terror.

KOAJaps, I’m beginning to see your points very clearly. I’ve never thought of GWB being on the right though by any stretch. To answer your question then, no, I see very little difference.

The “secret” info is Padilla’s own words in interrogation. The defense isn’t asking for access to operatives or means and methods. Any other defendant is allowed to review statements made in custody. They are an open part of any fair trial. And in an open, fair trial Padilla could say all the same things again. They are HIS OWN WORDS. How could they be Top Secret? This is so indicative of the contorted legal logic of the W’s with this guy.
The only apparent fact of this thug’s case is that he sought out and consorted with Al-Qaeda. My lord, if that in and of itself is not a case for treason, what on earth is? But, CHARGE him with that. The ever-changing, ever lowering degree of seriousness in the accusations of this case (dirty bomb to stove bomb to mayhem) just reveal what a farce and excuse for a naked power grab this has been from the beginning.
The rule of law must prevail. We shouldn’t trash our principles in order to “protect” them. As Cmdr. Charles Swift said regarding Hamdan:
“Itës not whether they deserve it or not. Itës how we conduct ourselves. Weëre the good guys. Weëre the guys who follow the rules and the people we fight are the bad guys and we show that every day when we follow the rules, regardless of what they do. Itës what sets us apart. Itës what makes us great and in my mind, itës what makes us undefeatable, ultimately. ”

Which program of CIANSANSCFBIPD do you work for Debbie?

Jose Padilla was the test case to see whether Americans would allow themselves to be persecuted by government as “terrorists”. We failed to stop it, so now all American citizens can be arbitrarily stripped of all their rights any time the government chooses to do so. US citizens can now be assassinated by the President at will.

What Constitution is that you’re supporting Debbie?
