Alhamdillullah [Praise allah]: David Letterman & NBC Say “There is No Palestine”

Ha!  No, this isn’t a joke.  Both David Letterman and NBC have stated in signed federal court documents–signed by their attorneys–that there is no “Palestine.”

David Letterman & NBC Tell Bruno Star/Terrorist Ayman Abu Aita:

“Sorry, There is NO Palestine”

Oh, sure, this is in court documents to get out of a lawsuit filed by Ayman Abu Aita, the Palestinian terrorist, against Sacha Baron Cohen because of a scene in his “Bruno” movie.  But who cares where they said it?  The important thing is that they said it at all.  In this case they said it in Ayman Abu Aita v. Sacha Noam Baron Cohen et al. Even better, NBC goes on to say, in its brief, “Palestine does not exist.”  Hey, they said it. And I’ve posted the legal documents from both below (and noted how Letterman’s high-priced lawyers screwed up–he had two of them working on a brief two page filing, and they still got it wrong).  I’ve also noted, below, how NBC was incorrect, unfortunately, about a few sad facts.

Aita is suing NBC Universal and Letterman, in addition to Cohen, because both showed that clip on their shows, when Cohen appeared to promote his movie.  As you’ll recall, the suit was filed by Aita–the former high-ranking member of Al-Aqsa Martyrs Brigades terrorist group–because he felt he was embarrassed by the gay “Bruno” character and because he claims he was never a terrorist.  Cohen interviewed him in the Ein El-Hilweh terrorist training . . . er, “Palestinian refugee” camp in Lebanon.

Aita claims he’s a citizen of the West Bank, Palestine.  But there’s no such recognized country, and unless he files as an alien citizen of a recognized nation–like, say, ISRAEL (which he won’t do because he refuses to recognize it)–he has no standing to file the case under the laws he’s invoking in federal court, and the court doesn’t have jurisdiction to hear the suit.  That’s the argument that Letterman and NBC are making, and it’s a valid one, which has been upheld in virtually every federal court, whether at the trial level or on appeal.

I wish Letterman and NBC had the guts to say on television what they’re saying on paper in order to get out of a lawsuit:  THERE. IS. NO. PALESTINE. Check out the documents.

Here’s Letterman’s Motion, which his high-priced fancy lawyers got wrong, since motions filed in federal court generally must be accompanied by a brief in support of the motion.  The title should have been “Motion and Brief in Support of . . . .”  A federal judge could throw it out or force his fancy lawyers–who didn’t earn their gold with this faux pas–to refile it.

Here are the key portions of NBC Universal”s Brief in Support of its Motion (yes, the NBC lawyers got right what Letterman’s didn’t).  Unfortunately, NBC is wrong about U.S. government documents not recognizing this fictional country of “Palestine,” as I’ve noted how the State of Illinois has done this with certain legal documents, unfortunately, and–as NBC’s lawyers point out–in violation of  U.S. law, and I’ve also noted how the U.S. government has been revoking birth and death certificates with “Jerusalem, Israel” marked as place of birth or death, changing it to “Jerusalem” without a country.  That, too, is, frankly, in violation of U.S. law.  And NBC gets this right.  (Please excuse my blue magic marker.)

Debbie as I understand:
Palestine has ALWAYS BEEN A REGION- Never a country. The West Bank – used to be part of Trans- Jordan; Gaza Strip, part of Egypt and the Golan Heights part of Lebanon. Isreal gained the land when THREE countries attacked it. It comes down to tha fact that Muslims in Israel don’t want to live under Jewish law. The could always move.

Based on what you posted, all that NBC and Letterman are doing are pointing out that the US government does not recognize Palestine as a nation. If this is a jurisdictional issue for the court to hear the case under the stated causes of action, then it is not an issue that NBC and Letterman could waive (although they could of course be silent on the issue in the pleadings/motions).

Certainly, in the court of public opinion they would be estopped from asserting that they actually support the notion that Palestine is a nation. I’m sure they will get a nasty letter from CAIR. But from a legal standpoint, their motion is agnostic, so to speak.

It will be interesting to see the plaintiff’s response. Even better, if the court takes jurisdiction by deeming the plaintiff an Israeli (unlikely).

Palestine is the ethnic cleansing name for Judea or Israel. The Romans gave the region that name in a failed attempt to erase the Jewish character of the land two thousand years ago. It failed. The ethnic cleansing term of “Palestine” stuck though, but it was not used for hundreds of years under the Ottoman Sultanate until a Brit brought it back to life by mislabeling Eretz Israel, “Palestine”. The so called west bank is another ethnic cleansing term. This time it was Muslim bigots that could not stand the thought of a Jew living in the Jewish ancestral homeland. For lack of a better term or lack of imagination, the Arabs of the East Bank labeled it “West Bank” in another failed attempt to erase the Jewish character of Judea and Samaria. Another failure. Jew haters never learn. Romans and Arabs do not seem to understand that as long as a single religious Jew remains alive there will be a spiritual connection with the land to its rightful owners. Conversely, there has never been a Palestine or a Palestinian people, nor were there a people called Jordanians. That name came about through lack of something historical to call it as well.

See the book “Rome and Jerusalem: The Clash of Ancient Civilizations.” by Martin Goodman. Goodman explains how the Romans used the Philistines to curse Judea.

Resurrecting the Roman Latin word Palestine was a British political decision that was constructed into protocol to enforce the policy of the Balfour Declaration, which delineated the geographical area of a former Turkish Vilayet in southern Syria to be set aside as a future land reservation for the Jews. Israel, in a way, like Syria, Lebanon, and Iraq grew out of the Sykes Picot agreement.

Golan Heights was a part of Syria, not Lebanon. However, Israel annexed it in 1982, and an UN Security Council resolution denouncing it at the time was vetoed by the US, so Golan Heights is very much a legitimate part of Israel – as Israeli as Haifa or Netanya.

Pretty ironic that NBC and Letterman would have to resort to
this tactic when it’s obvious they support a “Palestinian”
state. Michael Moore is right about one thing, we are a pretty
stupid nation. So few seem to know the real history of the
region that has been called Palestine.

I wish all these people who clamor for a Palestinian state
would work as hard to find a state for the Kurds or the Tibetans.

Legal Jihad doesn’t always work. Maybe the European’s and Asians are too afraid to insult the might of Islam but this is still America, land of the free and home of the brave.

Legal Jihad is really a scary thing–someone here sues Iran or one of the other barbaric Islamic nations and wins a judgment that’s never paid. Conversely, a murdering terrorist can sue and will collect…or be paid off (that airline dry-run story comes to mind).

Great article Debbie. People should be screaming this from their rooftops…and when this case gets tossed, maybe I’ll be passing out sweets in the street like those bastards did on 9/11.

Way back on March 31, 1977, the Dutch newspaper Trouw published an interview with Palestine Liberation Organization executive committee member Zahir Muhsein. Here’s what he said:

The Palestinian people does not exist. The creation of a Palestinian state is only a means for continuing our struggle against the state of Israel for our Arab unity. In reality today there is no difference between Jordanians, Palestinians, Syrians and Lebanese. Only for political and tactical reasons do we speak today about the existence of a Palestinian people, since Arab national interests demand that we posit the existence of a distinct “Palestinian people” to oppose Zionism.

For tactical reasons, Jordan, which is a sovereign state with defined borders, cannot raise claims to Haifa and Jaffa, while as a Palestinian, I can undoubtedly demand Haifa, Jaffa, Beer-Sheva and Jerusalem. However, the moment we reclaim our right to all of Palestine, we will not wait even a minute to unite Palestine and Jordan.

Palestine is demolished by Britain in the 1940s . Arabic inhabitants , including Christians , has killed and kicked out of Palestine . Most of the Palestinians are out of Palestine right now . For whom think that there’s no Palestine : Arabic countries were under Ottoman occupation for almost 400 years and they are independent now . Palestine is coming back whatever it takes and all the Israelis will be under the Arabic authority someday … They are not able to sustain cuz USA’s support won’t last forever …
