Trump & Sessions Cave on Sanctuary Cities, Betray ICE Agents

Donald Trump and Jeff Sessions caved on sanctuary cities and will no longer pursue defunding them for non-compliance with–and, in fact, defiance of–federal immigration law. And they waited to bury it during the week of his first international trip.



It turns out that all of the tough talk about sanctuary cities by Trump and Sessions was just that: talk. Empty talk. Bread and circuses for their masses. Smoke and mirrors. On Monday, Trump Attorney General Sessions significantly narrowed Trump’s executive order limiting federal funds from sanctuary cities. In fact, now most sanctuary cities will easily collect the money and go about welcoming illegal aliens and shielding them from immigration enforcement.

In a memo put out by Sessions, he defines sanctuary cities as ONLY those municipalities which decline to communicate information about the legal status of immigrants when asked to do so by the federal government. This means that cities and counties whose police forces actively refuse to cooperate with Immigration and Customs Enforcement detainers–and instead release illegal alien criminals from jail into the general population–are NOT “sanctuary cities” in the world according to Trump. And they will still collect federal grants. It also means that cities and counties whose police forces refuse to ask immigration status of those individuals they encounter and/or arrest, are also NOT “sanctuary cities” in the world according to Trump. And they, too, will still collect federal money. All they have to do is communicate (which they are already required to do), while declining to enforce, and they are covered.

Attorney General Jeff Sessions on Monday clarified President Trump’s executive order on so-called sanctuary cities, narrowly defining such jurisdictions–and the money they could expect to receive from the federal government–in a way that appeared to fall far short of Mr. Trump’s previous threats to starve all federal funding from localities that limit their cooperation with federal immigration enforcement. . . .

In a two-page memorandum, Mr. Sessions announced that the Trump administration would withhold certain types of federal aid from jurisdictions that “willfully refuse to comply” with a single federal immigration law. That statute requires cities, counties and states to allow local agencies and officials to exchange information about people’s immigration status with federal immigration authorities.

Only federal grants from the Justice Department and the Department of Homeland Security would be affected, Mr. Sessions said.

Under Sessions’ new “definition” of “sanctuary city,” all major sanctuary cities are in compliance with President Trump’s executive order and are not, for his purposes, “sanctuary cities”. With Sessions’ new policy, all major sanctuary cities and counties will continue to collect mega mucho money from the feds, include Wayne County, Michigan–the county seat of the City of Detroit. The county has one of America’s largest populations of Muslim illegal aliens and receives billions in federal tax money, each year. And its sheriff, Benny Napoleon–who was endorsed by the Muslim-dominated American Arab Political Action Committee–has instructed his deputy sheriffs not to comply with immigration law.

U.S. Immigration and Customs Enforcement officials say they’re “seriously concerned” about Wayne County Sheriff Benny Napoleon’s recent memo ordering staff to deny requests by agents to turn over immigrant inmates without an order signed by a federal judge or magistrate. An immigrant rights attorney said the Wayne County policy is the first of its kind in Michigan. . . .

In an April 28 memo from Napoleon obtained by The Detroit News, Napoleon wrote: “Effective immediately members of the Wayne County Sheriff’s Office shall not honor any (requests from ICE to detain prisoners) unless .. (it’s) accompanied by a warrant issued by a federal judge or magistrate. An administrative warrant issued by an ICE official may not be used to detain a subject.” . . .

ICE spokesman Khaalid Walls questioned whether Napoleon’s edict would allow dangerous undocumented immigrants to walk free, rather than being turned over to ICE for deportation.

And yet, under Donald Trump’s strange new definition of “sanctuary cities,” Wayne County will continue to collect its billions in federal dollars, with no penalty whatsoever for its defiance of federal immigration laws.

In other words, the new boss (Trump) is the same as the old boss (Obama). The only difference is that Trump lies about it and pretends he’s tough on sanctuary cities, when he is no such thing.

But none of the so-called “conservative” media are covering this (except me). And, luckily, for all the non-critical thinkers in this world, there is FOX News which falsely reported that, with this memo, Trump is actually getting tougher on sanctuary cities.

Again, he’s doing no such thing. Nope. Not even close.

Sessions issued the memo in the wake of a federal lawsuit against Trump’s sanctuary cities executive order. However, if every time a suit is filed, the Trumpniks cave, then what is the point of doing any executive orders? Liberals will know they can stop it all, merely by filing a lawsuit. Because, apparently, that’s all it takes to make Trump cave on his promises.

Thank you for telling the truth Debbie.You seem to be the only one who is as I have given up on cable news including Fox.This is indeed very disturbing news.We have turned into Europe and it greatly saddens me as I had high hopes for Trump but with each passing day he seems to do something to disappoint me.The illegals are giving us the middle finger and are laughing their asses at our country for how incredibly stupid we are.I don’t even recognize this country anymore.
Illegal aliens should be sent out of here not pampered and coddled to!Look forward to lots more terrorist attacks as this just gives the Muslims another avenue to do their evil deeds.Sanctuary cities,sharia law,giving in to all the Muslim demands,rewriting history in our school books.This country is making it so damn easy for them to take over!

Debbie all true on the current law on the books (re sharing information with DHS). The AG played it cagey in his talking points in March. Saying in effect “all we want people to do is follow federal law.”

Unfortunately all these sanctuaries figured out the policy, reviewed the law on the books and saw where they could toe the line. The left was celebrating this announcement, stating those who want to be sanctuaries just have to comply with DHS information sharing but (for example) can go right ahead and prohibit their Officers from asking the info of suspects in the first place.

The administration is asking Congress in the FY18 budget to change the law and add immigration detainer compliance penalties against sanctuary cities. Two things there. The left will fight all measures from the wall to this issue in the budget process, and even if it made it into law they’d just file more lawsuits as you pointed out.

06R: I think you give the Trump administration too much of a pass in saying they are asking Congress to change the law. But, in fact, the law is fine as it is (without Congress) because Trump made it via executive order. Now, he’s undercutting his own executive order. Trump set the executive order, which was fully legal, to cut off funding to sanctuary cities . . . to big fanfare. But it was all a lie and fake. Trump and HIS Justice Department have the right to set the definition of sanctuary cities is whatever definition Trump wants to set. Yet he and Sessions–NOT Congress–narrowed the definition severely on Monday, that it doesn’t apply to any sanctuary cities. This is on them. NOT Congress. If he is unwilling to get tough and enforce his executive orders, he should 1) not issue any and 2) give up on being President. We need a guy who keeps his promises, not another Bush-style swamp thing. And, yet, right now, we have that Bush-style swamp thing. DS

If Trump and his cabinet were truly serious, they would have plugged all loopholes and added provisions that would have stopped any leftist lawsuit or challenge dead in its tracks. But reading this, once again we see how Debbie had made predictions, a year or more ago, that would wind up coming true. Or to put it another way, “The Donald” living down to expectations.

And this is not just under cover of Trump’s foreign trip, but also in the wake of the bombing in Manchester, England, during an Ariana Grande concert. I am no fan of Ms. Grande’s, ahem, “music,” plus I recall vividly how she once tweeted that she hated America after being caught doing something in a donut shop that violated health code guidelines (in such a way that even Obama had disinvited her from some event), as well as apparently considering herself more a “global citizen” than an American based on her participation a few years ago in one of those top-down, One World elite-run “Global Citizen” concerts in New York’s Central Park – but none of those who attended, deserved to have all that happen to them, and as Debbie herself would have said about the attack, THIS. IS. ISLAM. Not to mention it being a case of “so much for Brexit.”

I have yet to see your comments on the mounting evidence of his and his administration’s treason, and it is indeed treason, in allowing Russia such an entree into American policy, his betrayal of Israeli-Israeli!- intelligence and his swor-dancing in Saudi Arabia, home of Al-Quaeda.

    You forget the breadth and depth of Obama and his clique’s long-standing ties with the Iranian mullahs, then (manifested among other things in that “nuclear deal”). You rather we have a President who’s a stooge of the Iranians and HAMAS as he was, and as Hillary would have been? Trump may be no prize, but what we are seeing here is an out-and-out coup being plotted. Democrats including Obama and Hillary were (and are) far more beholden to the Russians than Trump and his team are accused of being. Remember Obama’s hot-mic comments about “more flexibility” in negotiations, to Medvedev in 2012? Hillary’s signing off on a sale of our uranium reserves to a company tied to the Kremlin? None of our politicians today may be Mr. Clean, but it is also a truism that two wrongs don’t make a right.

Trump is a fool if he thinks he will garner any sympathy from his opponents by doing such a thing. Also, those people who took his promises seriously are going to become very alienated. Sessions is showing himself to be nothing but a coward in his new role.

Trump has been appeasing the Establishment since the day he got into office. Letting Hillary walk was the first and worst step. It showed they could get to him, Not going after Susan Rice or the leakers just aggravated and showcased his vulnerability further. I’m sure he knows who a number of them are.

His cabinet was one (even with Sessions) that Jeb could have picked — yes, even Jeb might have included one or two ‘conservatives’.

Meanwhile, the attacks against him go on unprecedented, not because so much of what he has done, but because he was elected without their help, so they aren’t sure what he might do sometime in the future.

He is not being attacked primarily for policy reasons. It is because of his ‘temperament’, the Russian fraud, the Comey firing, or one-line inaccurate or simplistic comments about actions or proposals he has made, with no serious analysis attached such as the Summers-Kerry duo at Harvard.

Yes, he does seem committed to improving the economic situation, but that will not be enough, either politically to get him re-elected (as he may think it will) or in terms of solving the problems that exist in the U.S. today which go much, much, deeper than economics.

I’m afraid the reason he won’t dig in his heels and rally his base is because he doesn’t want to go as far as they (or ‘we’ in this case) do. He may also be afraid, wrongly, I think, that defending himself vigorously and really challenging his detractors, as he did during the campaign, will cause excessive political instability. On the contrary, it would reduce political instability.

And, once again, the cacophony of opportunists and fools attacking Trump with the goal of removing him from office (all the way from shiftless Movement people to the Elite in various positions) gives us yet another illustration of the concerns of earlier critics of Democracy, as we near our 250th anniversary. Although not all their concerns or beliefs were correct or accurate, their fear of mob rule (egged on by an authoritarian elite) certainly was.

It is ironic that George Bush, and Clueless Condi have extolled the values of Democracy elsewhere in the world, but have nothing to say about its continued erosion here in the U.S.

TRump is at least deporting many gang members but like all politicians he has gone soft. First he has walked back moving embassy to Jerusalem. Two he has said he will build a wall. Now I am doubtful. Three, he is now backing down on defunding sanctuary cities.

I will still vote fir him again, however, I also wish he would strike down Religious land use institutionalize person act. The statute passed by CLinton has wrecked havoc in NY.

GB: Obama deported gang members, too. It’s not enough. He hasn’t kept his promises. He talks tough, but the only delivery I’ve seen so far is the Supreme Court Justice pick. DS

Another wall between the people who VOTED for TRUMP against tyranny, and the establishment & JUDICIARY, who really rule against the will of the majority of the people, and ignore the LAWS of the country, choosing how and when they will observe them to the letter. Ignoring the Legislative process will further erode our FREEDOMS, because they do NOT CARE.

In President Trump’s defense, he has been attacked mercilessly on a daily basis from the filthy, dirty, Demwits, and the even dirtier Media. Give the guy a minute to catch his breath. Once he gets the economy booming and adding jobs, jobs, jobs, he will get the backing of the people to fulfill his campaign promises. I don’t think he’s going to abandon us, he’s just laying a foundation to get these things accomplished.

MC: He got the backing of the people. It was called, “the election.” If not now, when? If he doesn’t do it now, he’ll never do it. The economy may not get better. We may go into a recession. If that happens, does that mean you have no problem with him not going after sanctuary cities? What if the Dems take over the House or all of Congress in the midterms? Then, he’ll never get to do it. The time is now. Don’t make excuses. He’s the President. And he’s giving sanctuary cities a pass, contrary to his loud pronouncements to the contrary. My take is that by allowing Gorsuch approval, the Republicans agreed to give in to Shumer and the Democrats on virtually anything else. This opinion is based upon my 15 years in DC many years ago that (1) what appears to be happening is not what is really happening, (2) things can always be worse and (3) the Democrats always get a pass.

To show just how much this was a cave-in: Any state or city that openly declared its intention to give the middle finger to the people they were sworn to protect (i.e. us) would have had funding immediately cut off without so much as a notice after their arrogant court challenges. That this kind of action was not taken, was the first sign that Trump and Sessions were p-footing on this. What Debbie reported on here was the ultimate culmination. (Same thing on his “travel ban” that wasn’t.)

And of course, Trump’s appeasements on matters like this only further embolden his enemies in the Democrat Party, the “deep state” and the media, who are already out for his scalp as it is.

And could it well be the ties of son-in-law Kushner to George Soros, why Trump and Sessions haven’t been going after funding for those subversive, anti-American groups that have become, if anything, more brazen and violent since his inauguration?

And if you appease the Left on one issue, you’ll cave on another – and another – and another . . . how many states (such as North Carolina) that have surrendered to the LGBTQ supremacist lobby on how bathrooms are designed and laid out (to cater to and accommodate a mere 0.3% of the population in a way that is completely discriminatory against the remaining 99.7%) will one day fold like a cheap fan to Muslim demands for prayer rooms in all public buildings, or building a mosque in a residential neighborhood in clear, direct and blatant violation of area zoning laws, or allowing women to wear burqas (the ultimate symbol of Islam’s oppression and subjugation of women) in public, or allowing men to wear full beards, or having a community ruled entirely under Sharia law (as in Dearbornistan, hence Debbie’s suit against them), etc., etc., etc. (as they had, a decade ago, viz footbaths in public bathrooms)?

And as for Trump himself, it appears to be a case of instead of draining the swamp, the swamp is draining him. “Swamp thing,” indeed.

Trump should know that this is a war and that the Left is not going to give up any ground without a bitter fight.

Moreover, they have infiltrated every important level of the US Government and run many state and local governments, making their job of ensuring that their agenda goes unopposed even easier.

They infest and inhabit our court system, including, for example, the Ninth and Fourth Circuits. They inhabit the CIA, whose former Director, John Brennan, for example, voted for Gus Hall, a communist leader well known in his day and Brennan has had a long-standing love affair with Islam. They inhabit the FBI and the U.S. Department of Homeland Security. I could go on and on.

If Trump won’t fight, what’s the point? Of course, he could always drop some bombs somewhere strategically to rally for some support, as he did in Syria (with insufficient evidence for responding in this way, IMO), to rave reviews from the Left. But that gimmick may eventually grow stale.

So, yes, things are looking pretty gloomy for America as we enter this Memorial Day weekend.

Speaking of gloomy, I will sign off with a tribute to Chris Cornell, who recently passed away. I heard a song he wrote on the radio called “Black Hole Sun” in the 1990s when it first came out. At the time, I hated the music of the 1990s, especially by comparison to the 1980s, a much better period for pop music. And so, the disc jockey nonetheless encouraged listeners to hear this relatively new grunge band called Soundgarden. Even though I did not normally like grunge music, I gave it a listen, and I was stunned by how good it was. The lyrics were surreal and that haunting Leslie electronic organ was beautiful. And Chris Cornell sang with a powerful emotional voice, passing what I call the “Frank Sinatra test”–that is, “Does the singer sound like he really believes the story he’s telling in his song?” Anyway, here’s a great live version that is as strong or stronger than the studio version. He was a real talent in the music business and will be missed.

Face it. There is still one way to cut off funding to san tuary cities. Consider moving to another city! Seriously. If you lived in a secessionist slave state and wanted to withdraw your financial support, this is what you would be purting into your decision chart as a possible solution.

(I cannot decide if there should be a comma between “secessionist” and “slave” because a state that ignores its voters and takes their money by force is enforcing a type of servitude to the ideas of an elite class. This elite class indoctrinates my children to believe that they are inferior; that public schools are meant to be large, managed way stations with free lunch and fre beeakfast, that new-comers deserve free stuff, and that my children should get uses to providing free stuff. Further, the elite indoctrinates the immigrant children to a culture of fear that their parents are inimminent danger of an uprising rhat will result in the loss of their parents and home: there is no hope in a better future in their home country, and the only way for them to have a fiture is to continue in the US by holding on to their status in a “welcoming city.”)

This is absolutely outrageous. If anything, Sessions should have pushed these cases to the Supreme Court ASAP. In fact, it needs to happen ASAP on the ‘Travel ban’ for starters, and then spread to the sanctuary city lawsuits.

Another (maybe more graceful) way to do this would be – in the budget, since there are cuts everywhere other than the military, totally eliminate any funding for sanctuary cities, regardless of what they do. Then it will just be a case of favoring some cities over others, which is par for the course in DC.

Other thing is that if they capitulate on this, their enemies will challenge even the narrow definition that Sessions has now applied. Only thing is – Trump is not averse to reversing himself if something backfires

My prediction is that he’ll flip flop any number of times until he comes to a point that works for him, be it in terms of budget, popularity and anything else. I hope such equilibrium states are those where he settles on the conservative position

Trump is turning out to be quite a disappointment. You have to ask yourself, who/what finally gets to these guys in office? We can’t even rely on someone that is not part of the political establishment.

As far as ICE, that agency has long been dead. With the lowest hiring standards in the federal government, it is never going to excel at anything. The best thing the government could do is to get rid of the agency and fold it into TSA. If the agency can’t do any enforcement or actual investigations at least they can check baggage and speed up the boarding process.

At this point the AG can only hang his hat on one section of law and it is vague. 8 USC 1373 requires “communication” – if they are doing that he really has no grounds, absent new law, to hold funding. AG withholds and gets beat in court once the issue is dead. The issue is really with (the Republican majority) congress to address further – they can place anti-sanctuary requirements in any bill that goes forward.

(a) In general
Notwithstanding any other provision of Federal, State, or local law, a Federal, State, or local government entity or official may not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual.
(b) Additional authority of government entities Notwithstanding any other provision of Federal, State, or local law, no person or agency may prohibit, or in any way restrict, a Federal, State, or local government entity from doing any of the following with respect to information regarding the immigration status, lawful or unlawful, of any individual:
(1) Sending such information to, or requesting or receiving such information from, the Immigration and Naturalization Service.
(2) Maintaining such information.
(3) Exchanging such information with any other Federal, State, or local government entity.
(c) Obligation to respond to inquiries
The Immigration and Naturalization Service shall respond to an inquiry by a Federal, State, or local government agency, seeking to verify or ascertain the citizenship or immigration status of any individual within the jurisdiction of the agency for any purpose authorized by law, by providing the requested verification or status information.
