EXCLUSIVE: Explicit DHS/ICE Lawsuit Sexual Harassment Affidavits; More Harassment of Men @ Obama’s Homeland Security

Readers who’ve been following the story I broke about the employment discrimination lawsuit against Homeland Security chief Janet Napolitano, brought by New York Immigration and Customs Enforcement (ICE) Special Agent in Charge James T. Hayes, have likely read about affidavits regarding sexual harassment by Napolitano’s hand-picked ICE Chief of Staff, Suzanne Barr a/k/a Suzy “Stripper Pole” Barr, who is now on leave. But only DebbieSchlussel.com has the affidavits, and I’m posting them here, today, for your reading pleasure. Read Affidavit A. Read Affidavit B. There are other affidavits and lawsuits to come (I am the attorney for several ICE agents who have employment discrimination claims against ICE and am available for hire). Also, here’s a letter from a supervisor in ICE’s Office of Diversity and Civil Rights to the attorney of another male ICE agent who has apparently filed an administrative complaint alleging anti-male discrimination in favor of female agents by a female supervisor at ICE. Suzy Barr: Obama Homeland Security Official Who Treated Male ICE Agents Like The “Magic Mike” Casting Couch

Partners in Harassment/Discrimination: DHS Chief Janet Napolitano & Flamboyant ICE Chief John (Moron) Morton

One of these affidavits, Affidavit B, claims that ICE New Orleans Special Agent in Charge Ray Parmer sexted to Barr, “I want to eat the corn out of your sh-t.” ICK. Who talks like that? It sounds like Dan Rather talking dirty with one of his silly cornpone countryisms mixed with the uber-nasty. And who in a position of power puts something like that in writing on an electronic device where it can be captured for later use? Anyone can say anything in an affidavit, and it may not be true, but it’s pretty specific language. As I’ve previously noted, the affidavits–from two different individuals–make allegations that Suzy Barr asked about male agents’ penises and expressed her desire to give oral sex. (You know what they say about fat chicks. And this is a fat chick drunk on power.)

Check out the ICE Anti-Fraternization Policy regarding “Romantic or Sexual Relationships between ICE Supervisors and Their Subordinates, written by ICE Director John “Moron” Morton and date-stamped June 6, 2011. It clearly prohibits Barr’s behavior. And yet a good deal of that behavior was conducted in front of and/or with the clear knowledge of Morton, himself. The first affidavit says he was in on Agent Parmer’s impersonation of another ICE official in the sexting incident (and if that really happened, Parmer should probably be fired for sexting on an Homeland Security apparatus and for impersonation of a federal official). Morton wrote in his policy:

Romantic or sexual relationships between ICE supervisors and their subordinate employees, to include those employees who they directly supervise or who fall directly within their chain of command, are contrary to a productive and efficient workplace. Supervisors must avoid the appearance of conflict between their professional responsibilities and any involvement that they may have in romantic or sexual relationships with subordinate employees. In order to avoid complaints of favoritism, loss of objectivity, abuse of authority, sexual harassment, hostile work environment, or gender based discrimination, supervisors should avoid situations that give rise to a conflict of interest or appearance of a conflict of interest. The very nature of these personal relationships in the workplace creates the potential for many foreseeable problems and workplace complications.


If a romantic or sexual relationship between a supervisor and his/her subordinate employee does arise, the supervisor involved must immediately notify his/her supervisor of the relationship. This requirement includes romantic or sexual relationships with anyone who falls within the supervisor’s chain of command (first-line subordinate, second-line subordinate, third-line subordinate, etc.).

According to the definition as set forth in the memo, Suzy Barr is a supervisor of pretty much every agent in ICE. Had she followed the policy set forth in the memo, she’d have had to report to Morton–her immediate supervisor–about every single male agent she’s hit on, given oral sex to, asked about his penis characteristics, and so on. That would be a list longer than Santa’s. How much you wanna bet no such list was ever submitted nor exists? And, yet, I know for a fact other agents have lost their jobs over this issue.

In any event, I predict that Suzy Barr won’t be coming back to ICE anytime soon. Even if Barack Obama is re-elected, Janet Napolitano would have to be a complete idiot to let her back into ICE headquarters. But if she does, one thing is for sure: it will be quite difficult for Barr to get a job after the Obama administration ends, whether that’s in a few months or four more years. Google her name, and her behavior is on display for the world. Who would hire her? Only a moron.

So sad, too bad. Crocodile tears from me.

And, by the way, John Morton–who knew or should have known all of this was going on–should be in the same shoes. Whoever hires him is an even bigger moron . . . and laying ground for future lawsuits.

At least Barr and Morton are going to get what they richly deserve.

No one is going to hire them because the last thing a company needs is to fight expensive lawsuits.

In the end something good will come from the frat party atmosphere at ICE though its too late for any one who has already worked there to say they have had a positive job experience.

Regardless of what happens in November and however these sexual harassment lawsuits ultimately get settled, don’t look for things at ICE to be turned around for the foreseeable future.

She not only sexually harasses the subordinate men under her command but she says (and responds) to the most unbelievably gross things that wouldn’t even turn on a passed-out drunk skid row bum. I just can’t understand it. I can’t see how the men (if any did) liked the weird-ass crap she said. My gosh, it’s ponderous!

AS usual, the major news media has an embargo on this story. My local rag, here in upsate NY, has written nothing. Don’t know if the always pathetic AP has bothered to do anything with this. If not, all 2,100+ newspapers in America are not reporting it as that’s where they get their national news.

The little guy gets even suspected, he/she is toast. OIG gets called in on some trumped up bullshit claim and lives/careers get ruined. The big turds in the beltway bowl and in SAC offices run rampant and nothing ever gets done, nobody held accountable.

These pathetic excuses for a human beings are treating federal employees and law enforcement officers especially as servants or hired help that they dont pay for. And as everyone know, when servant is taking abuse from the master he/she gets rewarded. Case in point, Highly Senior ERO official (who according to ICE broadcust was just a highly experienced DO!?! with no other “accomplishments” on his non-existent resume, on detail to front office at the time) took it like a man all those references to his “Johnson” and really became senior management in ERO and is in the process of getting his SES. Second corn-eating official got his coveted position in state he came from after engaging in god-knows-what type of games, verbal and oral misbehavior. Two others who was right there “serving” at the same time period all this happen, both “highly” experienced DOs barley made a grade and guess what? You guessed it, one was given NFTTU Deputy Assistant Director position despite OSC complaint and him not having supervisory expirience whatsoever (Danny was so good to him that he throw out priviously selected candidate, took NFTTU under Mission Support in a jiffy so he could make his own selection after our “highly” expirienced DO that was working directly for Suzy, makes time-in-grade requirement). I don’t know much about the other ERO servant, but I think he is the one that took over for our fast advancing DADio and got AFOD of his choosing, they even created position in the field for him and moved his IPN from HQ there, I believe his is getting ready to go to China as assistant attaché DLO or something. So folks, bend over and take it and you get what you most desire, don’t and they will set off their minions from OPR and OIG (those that are protecting them from real criminal allegations when their time to be investigated) on you and will not stop until they find dirt on you or just strech/manufacture your infarctions into something bigger. Class Warfare my elbow, you don’t have a chance to even look at the table they are eating their corn at, let alone to get some bread crumbs until you bend over.

Fred, DHS has very little to do with national security. DHS is a big Immigration and Customs agency with some hurricane chasers, the Coast Guard , U.S. Secret Service, TSA and a bunch of miniscule agencies that nobody has ever heard of thrown in because nobody else wanted them. The FBI takes the lead on ALL national security matters within the U.S. DHS is a huge do nothing but gobble up tax dollar boondoggle. DHS is a joke within government circles. Nobody takes them serious because DHS has neither clout nor an independent mission, with even less responsibility. The U.S. has not enforced Immigration law in my lifetime (58 years). Customs has been minimized for decades and the Coast Guard has been in at least 4 different Departments over the years. Both Secret Service and FEMA still operate independently of DHS because they both have more clout than Big Sis.
Get rid of it before the organism grows too large to destroy. DHS is expanding by the minute, acquiring real estate, building and re-branding to the tune of billions of dollars we can’t afford.

Bonzer Wolf, I agree, the status quo now is a direct result of the merger, the decline and transformation of Customs began in 2003. Oh I’m not saying Customs didn’t have their share of socio-paths and assholes, they did, but for the most part they were overwhelmed by the amount of work being done by the agents (in most SAC offices), so they had to at least feign like they knew what they were doing. Now this agency, DHS/ICE/HSI, has become a repository for the inexperienced, bumbling, sadistic bully type that are literally legends in their own minds, fake tough guys/girls with no clue. Yeah people are standing in line to get employed by ICE, where else can you get GS-13 pay, and above, without any professional experience or knowledge, and none expected of you? Everyone rags on the FBI, but their standards are higher (no not perfect) and they get the job done, who would you call in the event of a hostage situation or bank robbery, for example, ICE or the FBI? People criticize the FBI for their investigative failures; DHS/ICE/HSI gets criticized for their Clownism. There are virtually hundreds and hundreds of Clown managers in DHS/ICE/HSI that have no clue and are perfectly content to go through their careers in complete blissful ignorance. Yes, they play a good game and go through the motions of seeming like they know what they’re doing, and if you count car reports, and checking leave time or what time the agents come and go as the criteria of a good experienced agent/manager then they are, because that’s all they do, hanging around like the Maytag repairman waiting to get called. But that call doesn’t come any more, no more chicken processing plant roundups, not even a Chipotle sting. So, DHS/ICE/HSI’s sole mission has been transformed into just keeping the agency functioning, that means doing a lot of clerical and bureaucratic work, empowering the clerical staff and making the agents feel like second class citizens. There is no PROFESSIONAL law enforcement at DHS/ICE/HSI that is evident, it has become not only the laughing stock of all federal law enforcement, but also the Vegas, one goes to DHS/ICE/HSI contributes to its further decline and debauchery, and then moves on, what happens at DHS/ICE/HSI stays at DHS/ICE/HSI. Don’t expect it to change anytime this century.

In regards to Barr, as there were implied threats (loss of position, failure to be promoted, transfer, etc.) there was an element of force used. Those agents that were forced to have sex with Barr should file rape charges with the local police departments against her. The arrest will be immortalized on her criminal history forever, and will, in turn, strengthen the civil lawsuit against DHS.

In regards to ICE, what is truly enlightening is that all these supervisors/managers were knowledgeable about Barr’s noxious behavior for years and not one said anything until they got their asses got in a jamb. Those supervisors/managers should be fired. In Hayes’ case, specifically, as an SES he has signed a contract agreeing to uphold the principles of EEO. As Hayes was aware of the discriminatory behavior and he did nothing to stop it and made no notifications that it was occurring, Hayes concealed the crime and was a co-conspirator–he should be fired and prosecuted.

I was talking about you when I brought NFTTU dope (your favorite word) up, the one that has no godly reason to be a DAD, unless of course you hit that nasty thing you worked directly for and the one that is nationally acclaimed for being the nastiest ICE executive now and that my doppy friend is as good of a reason as any to be paid off. Bow your heads, and be humble. The creation of ICE in 2003 by combining Customs and INS has been a sore spot with many… but with or without this joining of agencies the many agents and officers of ICE (INS and Customs) themselves have committed acts that are completely detrimental to the success of any agency.

Acts of fraud, hit/run, sexual discrimination, all the way to killing and child pornography from the field agent level all the way to the higher echelons of management within ICE is a complete embarrassment, far worse than combining Customs and INS. I am not sure if there is another federal agency that has had the embarrassments that ICE has seen, and if there is another agency they must do a lot better job of keeping their dirty laundry in the closet.

Now we have high-level managers filing lawsuits against each other, somewhat frivolous lawsuits in my opinion, for the mere reason that the accusers today, were the perpetrators in the past, lets not forget the Black-Face incident. Someone said it correctly earlier, SB was allowed to remain and act in the manner she did for many years without anyone previously filing a complaint? It was OK before, but now someone’s feelings were hurt or ego threatened, so let us forget our past behaviors and act as the almighty and file for that which is wrong, in hopes of regaining power so that the wrongs can return but under a different leadership.

The acts of agents and officers hitting the media limelight every other week is deplorable, and it is those acts that bring this agency down. How about this, lets file a lawsuit because the agency decides to focus its apprehensions on criminal aliens. What’s wrong with that? If last year 400,000 aliens were deported and 50% were criminals, and this year 400,000 aliens are deported and 75% are criminals, well sounds like we are headed in the right direction. Arresting criminal aliens is harder than arresting non-criminal aliens, so maybe the real issue is having to work a little bit more for better results. ICE is a large agency, but it is never fully funded to complete its mission, so yes lets direct our enforcement efforts to issues that matter and impact our communities.

It sounds like you want to change the world with “let’s all be better” and forget the past, but don’t forget regular officers crimes, just what managers do and say. Yes, Suzy was doing whatever to hell she wanted for a long long time and no one reported her because everyone was scared and whipped into compliance. Now, even a little people feel the blood in the water and details of ICE management abuse of power keep pouring in from everywhere. As far as number of apprehensions, why don’t you go on AFGE or ICE Council website and read about it? They do explain it better why cops should not just concentrate on murders and totaly overlook little things like fraud and abuse of the public office. In case of immigration officers that would be the same as letting go non-criminals that just did not rape or murder anyone YET. Any law enforcement agency you look at, has specialized units to concentrate on the most heinous crimes and by comparison ICE has those too in abundance. When those units encounter less sexier violators they pass them down to other units to deal with, they do NOT let them go like ERO does, do they? Oh and not being fully funded!? Really??? These people creating positions overseas that costs millions of taxpayers dollars for their buddies and they don’t have the money to enforce the law? Quick! Someone, call the Congess and ask for more money and maybe, just maybe, they will spend it on what they have been originally charged with on doing, this time around.

In the words of Dylan Thomas villanelle, it’s time to “…Rage, rage… against the dyin’ of the light. For there shall be no mercy… for any force that stands… blocking this path of His righteousness! ” being Silly or WikiCool included. Trying to stand in front of the force that will scorch the earth around them, is not advisable in my “humble” opinion. Well, at least I wouldn’t, you do what you feel is right. And if you think that to be their advocate is proper, go for it.

My comments are not meant to change the world, and the damage done by those agents/officers etc. who have been arrested, convicted, fired, or still pending charges is all encompassing (GS-5 to SES). I bring up the past, because it cannot be forgotten, no where in my comments do I suggest forgetting the past. All LE agencies overlook crimes and that is a fact. Place a detainer on someone, and see how quickly an agency will drop charges or fail to file charges. Every time an LE agency fails to file charges they let that crime go, and the one less conviction, equals less chances of being deported, last time I checked everyone is cutting corners where they can, I think has something to do with the economy. Being funded for overseas positions comes from Congress, being funded for the number of detentions comes from Congress, and again neither are from a infinite pot of funds. Every agency operates under constraints. Of course, positions are filled outside of merit principles, but what agency doesn’t have that issue. There are allegations of fraud against a CBP union official now pending… so what makes reading what the union posts of any relevance. I form my thoughts and opinions based on what I see and know.

Humble is what some should practice, because it was their arrogance that got us to where we stand today. I am no ones advocate, but I try to look at whole situation, and it is not a pretty one, and there are many to blame.

WOW! Pulling tricks on kids with candy made out of selective honesty and murky waters. Everybody is guilty, so let’s not concentrate on certain people in power only? I think Not. They do selective arests, we should selectively blame them. You are partially right, but mostly wrong about most of it. But that’s how you get to sell your agenda to others with half truth and bait and switch, right? The Congress does provide funding for everything, but Agencies do spend according to their priorities. So, ICE priority was….to (again) spend millions of dollars on ONE position overseas and give it to a close and personal friend of…just go to DS piece on European vacation. Other LE agencies do sometimes let go of criminals, but not without at least creating a record on them and not on the massive scale with an official “blessing” or worse an order from the powers that be. So, stop piling everything into one bin in order to hide the truth. Retired former CBP Union President (not convicted yet) and all those crimes you brought up that was perpetrated by other officers has nothing to do with this story and only serve one purpose, it is to hide the fact that you are Tricking Those Kids making them to look away from the elephant in the room. I got to give it to you though, you are pretty good at it with that sincerity bit and concerns for all of us. It’s like watching a professional illusionist at his best. I almost bought it myself or do I owe you an apology?

That’s a funny picture you painted, I guess we know the same players in this band of power hungry clowns and jesters. A few more posts like yours exposing their lies, conduct, violations of federal regulations, harassment thechniques, etc…. and these people secret lives would be an open book to everybody. I believe that’s the only way to teach all mighty ones how to really be “humble” and be properly motivated to do a right thing. If not for the right reasons, then at least because they will be scared of ending up on the sidewalk like Suzy. Or maybe like Tiny Tim’s friend The Las Vegas Gambler that pawned his government issued weapons and lied about it under investigation. Now, I believe that Tiny Tim and Co. protected our DFOD for two years by placing him on admin leave, with pay mind you, even though he had criminal charges pending against him. The rules and regs are different that way, especially when it’s rank and file employee and/or them powerful ones just don’t like you. Under the same circumstances, regular servants get seven (7) days to clean their criminal mess and then they cut you loose. ICE High and Mighty with authority over employees’ lives, do not follow the same mundane rules that are designed primarily for plebs, do they now?

ICE is definitely not a fun agency to work for….btw, I was an aerospace engineer (not a LEO) back in 2002, when I saw an opportunity for promotion to GS-14 at US Customs supervising a small ballistics laboratory in Fort Benning, and decided to go for it. After getting selected and getting onboard (right after the creation of DHS, I was told that I would be working for the new agency ICE, and that I would have to supervise the former INS/Border Patrol armory in Altoona, PA (after buying a house near Fort Benning). After 2.5 years of nonstop TDY back and forth, I was given a forced PCS to Altoona. Not too long after I moved in there, I was the subject of multiple OPR investigations because a couple of employees were not happy with their work assignments who made all kinds of allegations–ranging from contract fraud (I was the COTR for all of the ICE firearms and ammunition contracts) to instigating a murder plot. I was all to happy to take a lateral job in a different agency, but fallout from working for ICE continues to follow me (I left ICE almost 5 years ago)….just recently I was interviewed as a subject by OSC because I was accused of committing prohibited personnel practices….as far as I’m concerned they should just break up DHS and send the agencies back from where they came from.

The pure evil of lying about people, slandering them, verbally abusing them, should be a CRIMINAL judgement.
