New York’s top Department of Homeland Security cop is suing Department of Homeland Security Chief Janet Napolitano in an explosive but heretofore unnoticed federal lawsuit alleging Homeland Security employment discrimination against straight male agents by Napolitano (READ the federal complaint) in favor of her lesbian girlfriend and sexual harassment of male agents by Napolitano’s handpicked Immigration and Customs Enforcement (ICE) Chief of Staff, Suzanne Barr. The lawsuit alleges that Barr demanded a male ICE Special Agent engage in oral sex with her and that she relocated three top male ICE agents’ offices to the men’s bathroom at ICE headquarters. All of the alleged misconduct was the behavior of Barack Obama’s hand-picked people running the Department of Homeland Security, who’ve created a hostile work environment for straight male agents, a story I recently broke on this site.

Many of the key allegations are stories I’ve broken on this site over the years, and the federal civil rights lawsuit gives more details. The 21-page federal federal complaint was filed in late May by New York Special Agent in Charge of Immigration and Customs Enforcement (ICE) James T. Hayes, New York’s top Homeland Security official. He was previously the ICE Director of Detention and Removal Operations, in charge of the deportation of illegal aliens around the country. It’s not every day that a federal official at that level files a lawsuit against the head of his agency.

Partners in Harassment/Discrimination: DHS Chief Janet Napolitano & Flamboyant ICE Chief John (Moron) Morton

The lawsuit further elucidates several stories reported on this site about discrimination against straight male Homeland Security officials in favor gay officials, including Napolitano’s girlfriend, Dora Schriro. As I noted, Schriro had zero experience in law enforcement, and yet, she was appointed ICE Policy Director and set the current Obama immigration enforcement policy of not enforcing immigration laws. (Schriro, who made a mess of Arizona’s prisons and empowered violent prisoners against prison guards, is now making a mess of New York’s prisons, a cushy job Napolitano got her so she could be close to a sick relative in New York.)

The suit also contains confirmation of another story I broke on this site, the sexual harassment of male Homeland Security Agents by ICE Chief of Staff Barr, who is known as “Suzy ‘Stripper Pole’ Barr” because Ms. Barr jokes that a building structural support in her office is a stripper pole, and she constantly harasses male agents in the vicinity of the “stripper pole,” including, sources say, dropping items and demanding the agents bend down to pick them up. Barr was brought to the Department of Homeland Security from Arizona by Napolitano and installed as ICE Chief of Staff. She was previously Napolitano’s Chief of Staff in the Arizona Gubernatorial office and has absolutely no law enforcement experience. Agents say that this bimbo, Barr, is the person really running ICE (the Department of Homeland Security’s largest agency), not Obama appointee John Morton, whom Napolitano didn’t want in charge of ICE. The “Fifty Shades of Grey” books ain’t got nothin’ on this pervert-ette. The suit states,

Barr humiliated another male employee by calling that male employee in his hotel room and screaming at him that she wanted ‘his c-ck in the back of [her] throat.

It goes on to say,

Barr covertly took an ICE blackberry [sic] device assigned to a male Special Agent in Charge and set a Blackberry Messenger message to his female supervisor indicating that the male employee had a crush on the female supervisor and fantasized about her. These actions and others . . . were all taken to humiliate and intimidate male employees. . . . Barr promoted and otherwise rewarded those male employees who woulod play along with her sexually charged games including the three male employees whose office she relocated to the men’s bathroom at ICE headquarters.


With regard to Napolitano and her girlfriend Schriro, the suit alleges that Napolitano replaced Hayes with Schriro at meetings and in policy decisions regarding removal of illegal aliens:

Schriro was named as a Special Advisor to Secretary Napolitano on Detention and Removal Operations. . . . Schriro was not as qualified for the position Plaintiff had because of her lack of Federal law enforcement experience. . . . Schriro enjoyed a long standing relationship with the Secretary. Plaintiff believe that he was being replaced in his duties because of this relationship. . . .

Plaintiff was aware that Schriro enjoyed a long standing relationship with Plaintiff’s ultimate supervisor, Secrtary Napolitano, and that Napolitano was promoting Schriro because of this relationship, and not because of any relevant skills, over Plaintiff, who had far more relevant experience in the field.

Hayes’ lawsuit claims that he was repeatedly turned down for and/or jerked around regarding assignments and promotions that he sought within ICE and that this harmed him economically. He also claimed that when he complained about this he was retaliated against. He cites several investigations against him by the ICE Office of Professional Responsibility (OPR) that he claims are trumped up.

I should note that one such investigation involves Hayes’ attendance at a San Diego Padres Major League Baseball game at which Hayes and another ICE official who is apparently his friend, the incredibly sleazy and dishonest John P. Torres (who used ICE funds to get his extra-marital girlfriends jobs for which they were not qualified, etc.), were sitting in box seats. (Torres is now ICE Special Agent in Charge in Washington, DC, because the sleaze and crap at ICE always rises to the top.) Hayes has his share of detractors, and several ICE agents complained to me about this incident, saying that government funds were used so they could fly to San Diego (where they say a convenient, phony “government meeting” was set up as an excuse) and that the box seats were provided to them either free of charge or at a significantly discounted rate, in violation of ICE rules. Hayes alleges in his complaint that he did nothing wrong, that there was legitimate “government business,” and that he was cleared in the OPR investigation.

Regardless of the veracity of either side of that issue, I have heard one thing universally from the many ICE agents and Homeland Security officials who contact me on a regular basis:

That Janet Napolitano and Department of Homeland Security officials running Immigration and Customs Enforcement discriminate against straight male agents (in favor of gay agents) and harass them. And that Suzy Barr constantly sexually harasses male agents in an open, consistent pattern and practice without any negative or disciplinary response from Napolitano or anyone in the Obama administration. (Several agents believe that Obama ICE Chief John Morton is bisexual and that this is part of the reason he allows this behavior and discrimination to continue under his watch. As I’ve noted, the man he appointed to be his deputy, Dan Ragsdale, is openly gay and harasses straight male agents regularly. When John Morton leaves ICE, Ragsdale will be running the show and many agents have questions about their relationship. As I also told you, Morton’s Assistant Deputy is lesbian Beth Gibson, for whom a new, waste-of-money government job was created so she could be near her girlfriend in Colorado, and ICE money was wasted so top officials could attend the girlfriend’s ICE Academy graduation.) All of these Obama officials and their cronies use ICE as their own personal harem, and straight males are the victims.

And this is why so many ICE agents plan to vote for Mitt Romney and cannot wait until the cretinous Obama incompetents running the agency are out. And it’s why, as I’ve repeatedly noted on this site, morale couldn’t get lower at ICE under Obama, and its employees rank it near the bottom of government agencies. The lawsuit’s allegations only confirm that.

Back in the early 80’s we had an SCI in NYC who was an arrogant POS. Slats had him convinced that a 13 was in his future. He’d do things like ask a couple of guys in his squad to bring his paycheck when he was out sick, then report them for misuse of a GOV.

When folks complained he told them it was the privilege of rank.

One time he told folks if they didn’t like it to go to OPR. Next morning there were about 30 guys lined up outside the OPR office. He got 60 days on the beach.

I’ll ignore the juvenile profanity. Read my posts VERY carefully: You’ll see that I speak about MY dealings with Jim; I can’t speak for anyone else, and everyone is certainly entitled to their opinions.

Regardless of your animus towards SAC Hayes, the simple fact of the matter is that I laid out a very compelling case as to the very rare nature of lawsuits of this type (i.e., a sitting SES going against the politically-appointed head of his parent agency) and the implications thereof; I also pointed out that there is, in fact, a concerted effort to develop and advance gays, lesbians, and black/Latin females, all at white males’ expense. If you don’t see this, you are either blind or a fool.

This foolishness is resulting in the rapid decay of the morale and base of this agency: When a class of individuals (in this case, white males, who, may I say, comprise a VERY significant portion of the agency’s race/gender make-up) feels that they have been effectively marginalized to the point that they would rather take out money from their TSPs and try to strike out on their own, branching off into outside employment opportunities, it can only serve to hasten the deterioration of this agency’s mission – who is doing the work if agents, who feel they have no chance at career development or advancement, are out opening liquor stores (yes, you heard right, liquor stores) or nutritional supply outlets, thereby putting their energies into those endeavors, instead of doing the work that should be done?

This is only going to get worse, and I don’t see any corrective action coming anytime soon. I agree with Bonzer Wolf – the FBI is probably reading this post and comments with glee, and slipping it to their congressional liaisons in an attempt to further demonstrate why HSI cannot be trusted with the nation’s business, and why THEY should be given increases in staffing, budget and a larger role in border security.

This disgusts me, as it should every decent, hard-working agent: we had better get it together, and fast, before the next 9/11 happens, and the blame goes squarely on us for a house that is now publicly apparent to be out of good order, and with a complete lack of discipline.

I’m sure you are a decent Guy/Gal but you have NO concept of what ACE is capable of. And, since you called me out, I will take a moment to expose you and your ignorance about the SES. Members of the SES get “unlimited sick leave”? So do you. They earn no more sick leave than you and they do not accumulate more than you. And you wrote, “and get paid for it ALL upon retirement for unused balances”. No different than you. They don’t get “paid” for their sick leave but they do get to apply sick leave toward their retirement. Just like you do. “Also, SESs get a paid move to the retirement location of their choice”. Wrong. If they get moved by the government while they are an SES position…the government will move them to the location of their choice. No guaranteed home sale, just movement of household goods.
I’ve been on this planet a few years, working in prisons, detention centers, arresting aliens, releasing aliens…many crazy…some not so crazy but I would have to say that ACE(Jimmy Hayes) is the most rotten, soulless, self-absorbed, arrogant, dishonest, self-serving, piece of human excrement that I have ever had the misfortune of dealing with. This snot nosed punk came out of nowhere and was selected by his sleazeball buddy, John Torres, as the Field Office Director of the ERO Los Angeles Field Office. ACE was ranked #9 out of 9 candidates and Torres picked him anyway. Torres passed over 8 ERO candidates and picked ACE. He went in…not humble…not appreciative but with an arrogance that I’ve not seen in my lifetime. He branded people who had forgotten more about detaining and removing people than ACE will ever know as “problems” and ruined their careers. There is an annoying set of rules called the “Merit System Principles” that dictate how selections and promotions are to be made in the federal government. Torres and ACE shit all over them. I could go on and on and on but I don’t want to waste one more minute of my time on that turd called Jim Hayes. He has no “balls” he has no courage and he is a coward. He should be in jail. He and Torres did what they wanted because the head of the ICE Office of Professional Responsibility (the Gestapo of ICE), Tim Moynihan ,worked for Torres and was not going to run afoul of him. Little Jimmy has just opened Pandora’s box and ALL of the things that he and his POS buddy, Torres, did are going to come to light. The legacy Customs punk, Tim Moynihan, better be worried too. All of the things that were reported to OPR and weren’t investigated by him and his storm troopers will now be investigated by other agencies. Like DHS OIG and the FBI. May a thousand fleas infest the nether regions of ACE, Torres and their evil spawn.

    Jim Hayes was elevated to a position of leadership within ICE ERO & INV not because he had the background, experience and education but because he was following John Torres so closely that if John Torres stopped short, Mr. Hayes would have found himself deep into John Torres’ inner sanctum. Mr. Jim Hayes never even served as a first-line supervisor either in the field or in INS / ICE Headquarters. Jim Hayes and John Torres travelled from Washington to San Diego, on the Tax-payers dime, to attend a Padres Baseball game. This was reported to ICE’s Office of Internal
    Affairs (OIA) but the Director of the OIA, Tim Moynihan, white-washed the investigation. Also while in ICE Headquarters, Mr. Hayes would detail his girlfriend in the Los Angeles Office for short details to ICE Headquarters in Washington. At the same time Mr. Torres was impregnating his mistress who was a Special Agent in the ICE Baltimore Field Office. Though I agree that much of what Mr. Hayes says about Janet Napolitano, the “flamboyant” John Morton, Susie Barr, Beth Gibson are mostly true, this is very much like “The Pot calling the Kettle black”.

    I can’t really say that I have much sympathy for Mr. Hayes for the following reasons:

    He seems to have had quite a meteoric rise in the agency from his beginnings as a BPA (probably GS5 or 7) in 1995 to a GS-15 only 10 years later. Having only about 2 or 3 years experience as a criminal investigator street agent in INS he subsequently became Special Agent In Charge of Homeland Security Investigations New York.

    Apparently, he began filing EEO complaints in May 2011 when he was not selected for the position of Special Agent In Charge Los Angeles and his lawsuit seems stem from that event.

    While the allegations of favoritism and sexual harassment might very well be true, I wonder if any of these allegations are contained in his EEO filings.

    Even if they are contained in the 2011 EEO complaint, why did it take so long. The reported events of discrimination and sexual harassment took place in 2009, some 3 years ago. If this GS-15 Manager had really been offended by that activity, why did he not take appropriate action at that time to report and curtail the activity.

    I might be a little cynical, but in my opinion Mr. Hayes was probably perfectly fine with things as they were until he didn’t get the position he wanted.

    This is of course just my opinion, and you know what the old adage says about opinions. I’m just glad that I retired prior to the formation of the HSI/CBP monstrosity

Hayes apparently was in border patrol (more akin to security than law enforcement), and then became an INS “special agent” whose primary duty was writing up and serving jailed illegal aliens with deportation paperwork in Orange county California. After the merger, Hayes went into Detention and Removal Operations (DRO) as that organization was more in line with his previous experience.

Eventually, Hayes got promoted to the Special Agent in Charge (SAC) position for Homeland Security Investigations (HSI) in New York City, with little to no actual law enforcement experience, and no investigations experience. Someone also mentioned that Hayes has a degree from Park University, some sort of online degree mill. With so little relevant experience and qualifications, and no level of accreditation, how could Hayes possibly get a SAC position? Answer: favoritism. Hayes seems to have no problems with favoritism when it benefits him, but then files a lawsuit when he no longer benefits from favoritism and it is being given to others. Mr. Hayes, how about advancing the traditional way, hard work?

Let me preface my comments by saying that I’m not a manager, but a working agent. Since SAC Hayes came to NY in 2009, I haven’t had many direct dealings with him, but the ones I’ve had have been professional and friendly. I also haven’t heard much that was negative about him through the office grapevine, which is unusual for an office of over 400 agents where griping is a daily pastime. I don’t know what he did before he came to NY, but anyone who puts his career on the line like he did with this lawsuit has got to either be very confident of success, or else just totally crazy, and I don’t think he’s crazy. Given the numerous disgraceful allegations contained in the lawsuit (which I personally believe to be very credible, based on what I’ve seen in many years of federal service), I hope it results in a long overdue and well-deserved shakeup at ICE and DHS.

So don’t worry “honky” ain’t no “darkies” taking over, just seems that way. As for the EEO, white man ususally gets settled, so this man Haye’s gonna get his second retirement package.

It’s the Black and Hispanic agent that file EEOs that get fought every step of the way by ICE. The “minority” population in management at ICE is actually very low, just Google the numbers.

One area ICE dont definitely discriminate is in the hiring and promotion of Clowns and assholes.

What an embarrassment to our agency, and I mean Hayes. This guy was bitching and threatening a lawsuit from the day the new administration came in. Political appointees regulatory shuffle the deck with career employees when they come on board, Hayes wasn’t special, they could quickly see the guy was out of his depth. He had no business running ERO whatsoever, what was his background anyway? Some patrol, some agent, and a lot of time sucking up at HQ. Then boom, he’s the the FOD of LA and an expert? Please.

After all that he considers the SAC of NY some kind of a step down? He is seriously deluded. Someone on here said he must really have the goods or be crazy……well, the dude IS off. There are certainly some nuggets of truth in his complaint, but there was no conspiracy against him. He was just exposed as a foul tempered, poorly educated, intellectually wanting careerist. And even after that he was given the premier SAC in the entire agency and he complains. God help us all if this childish and immature man child ever gets anymore authority than he already has.

BTW, there is no gay mafia running ICE. No one would know Ragsdale was gay, he doesn’t wear it on his sleeve. Morton, Dinkins, Chaparro, Woods, Winchell most FODs and most SACS are all straight white men. Believe me, there is still hope for us yet. The bigger issue is cronyism, whether it is being drinking buddies, golf buddies, gay/lesbian buddies, Hispanic buddies…all of these people look out for their friends. If you simply bust your ass at work and go home to your family, you are out of luck, whether you are white, black, gay, straight or Latino. This agency has become all about the contacts, something Hayes exploited to the maximum. Seems like now he has a complaint but when he was benefitting from that environment all he did was enjoy the ride.

Hayes will be exposed for the unqualified, incompetent loser he is. If his suit shines some light along the way on the nature of cronyism here at ICE great, but he will get nothing. I’ll be here to check back in to say “I told you so” and eat crow if I am wrong. One thing I am not wrong on is the guy himself, Hayes’ own history will prove his undoing, and not the anti-white male conspiracy he imagines. Hayes is the one nightmare always cited by legacy Customs agents that I cannot refute about Legacy INS guys, he is the clearest example of someone leveraging their contacts to launch a career. And now a lawsuit….pathetic.

Whenever you want to do favors for your paramours at HQ (go ahead look it up on Wikipedia you reprehensible turd)…I’ll be there. Whenever you and your enabler, John Torres, want to commit gross violations of the Merit System Principles…I’ll be there. And so will every other person you’ve ever screwed over. And, unlike your Johnson, the list is long and distinguished. You are a hypocrite of the highest order to file this suit. I hope to God that ICE, for once, sticks to its guns and exposes you for what you are. A privileged crybaby who would still be making copies for a real agent in a SAC office somewhere if it weren’t for John Torres. The first time in your short and undistinguished (like your Johnson) career you had to work without Sugar Daddy John’s protection and you were fired. Boo hoo. For every word in your frivolous lawsuit, there is a person out there that suffered under your hostile work environment. Karma baby. Karma. Your colossal intelligence did not allow you to understand one of the basic tenets of leadership. If you are going to hold people’s feet to the fire, you’d better walk the straight and narrow. This is nothing new, janet napolitana and dora schriro have a long standing history of this in Arizona. While working in Arizona State she had infamous open fueds with the current prisons director and when she became govenor forced him out of service. The state legislature then appropriated $250,000 to pay a consulting firm to recruit and screen a replacement as director of Arizona prisons. After many months they developed 02 finalists (one from CA DOC the other from TX DOC) when provided these cantidates napolitano rejected both and hired dora schriro via backdoor to assume the post. dora schriro had recently been fired from new york city corrections. they procedded to demoralize and destroy the Arizona prison system and set the stage for the longest prison hostage situation in national history. (Thats another story entirely). We joked in Arizona that napolitano was dora’s sugar momma and where ever nopalitano went dora would not be far behind.

Very amusing, but totally wrong. I hope you don’t jump to conclusions like this in your investigations, assuming you are a criminal investigator.

I’m definitely not him, but I’ve been an 1811 for a long time, and have seen a lot in my career. And regardless of “what he is”, the issue as I see it is the substance of his allegations, not him personally. If true, they are very serious, and need to be addressed for the good of the agency and our country, regardless of any bad blood between you, him or anyone else.

Another reason that Hayes’ lawsuit is so stupid: if this was a bias against white males in favor of women, then why was Marcy Forman sacked and replaced with a white male, Jim Dinkins? Why was Hayes replaced with a white male, Gary Mead? Why was a Latino male, John Torres, replaced with another Latino male, Al Pena? Where are all the women who came in and took over?

This administration came in and cleaned house with the existing career staff. I didn’t see Torres or Foreman filing suits. Why wouldn’t someone want their own team? Finally, as an SES, you don’t have the same type of job security in your position that lower graded employees do. Instead of dealing with the fact that the new administration didn’t want some meathead with an online degree running a 2.5 billion dollar organization, he cries foul and discrimination. What a joke!

On the surface it looks like the agency is being run by some who have no idea how a professional workplace should be run.

Reading the comments here it looks like a bunch of empty suits who needed a kick in the ass, got it and are still smarting that they had to actually work for someone who might have been younger or less experienced than themselves. If you were such superior agents why are you whining and bitching from a keyboard? You obviously were inferior in your superiors eyes and probably everyone else around you even though they didnt tell you. But take heart because as you seethe sitting at home you can keep convincing yourself that you are or were an agent that all others should aspire to be. Just dont forget that when the alarm goes off Monday morning you will still be a whiner and know it all as you sit down at your cubicle in the office (probably after exchanging pleasantries with someone that you disparaged here).

As we get close to election time and the appointees realize their party time is over, travel to and expenses for trips, parties and visits to the most exotically located offices worldwide will double. Prepare to hear of boondoggles, government sponsored trips, fraud, waste and abuse. The question is what is the Department’s response. This “leadership” lacks integrity and they share a since of entitlement. Shortly after they are appointed they take on this ridiculous notion they are somebody. This isn’t just the talk of the NY office, this was the topic in HSI offices all over the country.

I’d like to see this lawsuit take its course. It’s about time some of these antics were exposed. I wish Mr. Hayes luck in his endeavour.

On the other hand, I know agents who have been 1811s much longer than Mr. Hayes and who have attempted to enhance, diversify and advance their career only to be hindered by the lack of a “hook” or juice. Agents have attempted to “lateral” over to other areas in HSI over and over and over and over and over and over again only to be met with disappointment and fustration with seeing less qualified people get the positions. Agents have taken the 14 test over and over again and been on multiple lists only to see less experienced agents obtain supervisory jobs. Maybe these relentless agents are trying to climb the career ladder, maybe they’re trying to better themselves OR MAYBE THEY’RE JUST TRYING TO BRING A LITTLE BETTER QUALITY OF LIFE TO THEIR FAMILY.

But what are these relentless agents met with time and time and time and time again, ‘sorry buddy, not this time, try again’.

Are some of these agents “whiners”? Maybe. Or maybe they’re just a bit bitter because they’re closed out of the HSI career ladder and see their career in a stall.

Having said all that the only cliche’ I can think of is “Karma Sucks”,sir.

I wish you luck in your lawsuit Sir, but remember there are people in your office who have suffered the same indignation from the treatment they’ve received.

Ask JH why back in late 2005 when M Forman and John Clark where in charge and they selected him to run the Human Smuggling Trafficking Center (HSTC) he got caught embellishing on his resume regarding gang enforcement in Orange County and was subsequently denied the position when his claims were found to be false. ICE got a big time black eye on that one. Then instead of demoting him they let him keep his 15 and tried to send him to SAC/LA as an ASAC. That’s when JT stepped in and gave him the FOD position.

The Truth –

That was a pretty funny post, and definitely some truth to the whiner factor – with folks heading back to their cubes muttering how unfair it is. However, this is at least one instance where some of these whiners are right on point. The real truth is that there is a better way to place people in executive and leadership positions. There are plenty of people here in ICE who have rapidly ascended the career ladder to SES positions by 40 and they are not disparaged here. Some ARE that good, sharp and knowledgeable. You don’t see people banging on HSI Director Dinkins here, even if he does make decisions that some agents might disagree with on his policies. Kumar Kibble, the last Deputy Director was young and ambitious, and again, very little criticism. Al Pena, great guy, the list goes on of people that these whiners respect. This guy Hayes is an exception.

It is not just his subordinates who were shocked by his rise, but his peers as well. He was never qualified for any of the jobs he held, then he questions the qualifications of Schiro? This woman was the DIRECTOR of corrections in two states. It is natural for political appointees to place their own people in on major issues of policy. So what that Nobbslitano put her in charge of detention policy. What…Hayes with his 2 years of experience overseeing Federal immigration detention is so much more qualified that someone with 25 years in the state and local business? She was never the Director of ERO anyway, but if Napilatano wanted her to be the point person on detention policy changes within ICE, that’s her prerogative. Hayes didn’t know anything about deportation and detention before he was FOD, talk about unqualified. Two years there and he is detailed to run the show at HQ and then gets the permanent job. I call that dangerous. Hayes basing his lawsuit that he was bypassed in favor of someone less qualified is laughable. How many Deportation Officers and Supervisors with decades of experience were passed over for him?

Hayes was on a meteoric rise that made no sense to anyone, probably even himself. A lot of the senior ICE attorney staff at HQ knew Morton from back in the day when he worked with INS. I’d bet those same people gave him an assessment of Marcy Forman, John Torres, and Jim Hayes, and I’d bet it was not good (although there were some who did like Hayes’ decisiveness I am told).

Hayes getting the boot had nothing to do with Barr. She might well deserve to get fired for harassing statements, but poor Jim Hayes wasn’t targeted for reassignment because he was male. That theory loses all grounding when the replacements for the ICE Deputy Director, ERO Director, and HSI Director were ALL males. This is just further proof of what a dope this guy is.

Bottom line, this guy had been faking it his whole career, and finally got found out. There are plenty of SACs and leaders (Dinkins for example) that were real agents, then real supervisors, real mid-level managers, real senior managers then finally executives based on merit. Hayes was an unheralded patrol agent, a special agent for a few years, then maneuvered his way through HQ to get a 15 without a day as a field supervisor at any level in ANY organization. This is a guy you make FOD of LA, then acting director ERO, then Director? It was a mistake. He only got the SAC NY job because he was making so much noise about a filing a suit. Any other agency would have laughed at this guy and his out-sized mannerisms coupled with his HS diploma.

I have no idea if Barr said or did the things he alleges, if so she should be dealt with. But to see this guy complain about being aside for a woman with fewer qualifications (as if he had any himself) is pathetic. He is and will remain an embarrassment to ICE until he retires, which since he is only 40 or so, is far tooooooo long.

And BTW, I am generally satisfied with my career and where it stands, so I am not whining, just telling the — truth.

    I think a lot of folks are missing the point. Was JH promoted based on cronyism? Yep. Did Napolitano/Morton come in and do some rearranging? Yep. Does cronyism still exist in the agency? Yep. But JH is claiming retaliation in his lawsuit based on his previous EEO filing. With all of the antics and “non-competitive appointments” that take place ON A DAILY BASIS in all offices throughout DHS, there might be some merit to his claims. All I can say is that it’s a sad day. DHS is a disgrace and a failed experiment. We are no safer now than we were prior to 9/11, and we sit here and bitch about which administration is worse. They both suck, they both are FULL of political hacks and, let’s face it folks, we’re more concerned with one-off interdictions and cracking down on fake Rolexes that we are with securing the borders and protecting national security. I don’t care what legacy agency folks are from, DHS is all about the stats and not about the long term goals. That’s why the Bureau kicks DHS’ ass at everything.

Hayes has many, many haters, and all with good cause, because as it was said already when he was the benefactor of the quick and unqualified promotions, things were good. There is nothing wrong with being SAC of NY, but this boy’s ego is soo large, he cant help himself, but want even more…

FOD Robin Baker was never OI or HSI, but is far more qualified to be a Director or SAC any day of the week including Sunday.

Hayes is lucky to have what he has, but he is a “cancer” that needs to be put to rest.

There may be some truths to this suit, to bad the Plaintiff is just as guilty.

Remember, the secretary moved to terminate 8 career secret service agents based on the unconfirmed allegations of a foreign prostitute. Here, a career employee has made specific factual allegations that he alleges can be easily substantiated, and without any kind of enquiry whatsoever, the secretary attempts to sweep those allegations under the rug by simply declaring them unfounded. Where is the anger from career employees who have been treated like sh*t while Morton and Barr have used taxpayer funds to pay for their worldwide par-tey??

I don’t know Hayes and have heard both good and terrible – eye of the beholder, etc. But I am HSI SA who recently returned from a tour overseas and had the hardest time getting ANY location, let alone back home. I ended up in Intel, because OIA was forcing me out (according to the new career path) and there was no where else, at least I was told, available.

I was at the recent conference in New Orleans (May 30-31) and heard a story going around that makes me believe these claims. Barr was at the conference as well, and sent a post-it note to an agent she liked. Said to meet her in her hotel room at a certain time. He shows it to another guy, a witness, Caben Chester, and says what do I do? Caben says stay away, she’s dangerous – but doesn’t realize Barr had migrated to be standing next to them. Barr tells the agent she sent the post-it note to that if he knows what’s good for his career, he’ll meet her in her room.

The next day, the guy tells Caben he did it, banged her all night, and shows him pictures of Barr naked and says – this is my insurance in case she does to me what she has done to everyone else.

Scary stuff for an agency supposedly protecting the country. Ask Caben.

This isn’t about people complaining that such and such got a job over another. This is about an incompetent complaining that he is being replaced by another incompetent because he was a man, yet ultimately being replaced by a man. This man (Hayes) has the ability not only to make his employees’ lives miserable, but to affect public safety, government efficiency, and national security. It is frightening that someone like him has the authority and power he does. Not that he’d use it for evil purposes, but his sheer incompetence could endanger us.
