EXCLUSIVE: Top NY Homeland Security Cop Sues Napolitano; Alleges Obama DHS Officials’ Anti-Straight Discrimination, Demands for Oral Sex – “J-No Appointed Lesbian Girlfriend, ICE Chief of Staff Harassed Male Agents”

New York’s top Department of Homeland Security cop is suing Department of Homeland Security Chief Janet Napolitano in an explosive but heretofore unnoticed federal lawsuit alleging Homeland Security employment discrimination against straight male agents by Napolitano (READ the federal complaint) in favor of her lesbian girlfriend and sexual harassment of male agents by Napolitano’s handpicked Immigration and Customs Enforcement (ICE) Chief of Staff, Suzanne Barr. The lawsuit alleges that Barr demanded a male ICE Special Agent engage in oral sex with her and that she relocated three top male ICE agents’ offices to the men’s bathroom at ICE headquarters. All of the alleged misconduct was the behavior of Barack Obama’s hand-picked people running the Department of Homeland Security, who’ve created a hostile work environment for straight male agents, a story I recently broke on this site.

Many of the key allegations are stories I’ve broken on this site over the years, and the federal civil rights lawsuit gives more details. The 21-page federal federal complaint was filed in late May by New York Special Agent in Charge of Immigration and Customs Enforcement (ICE) James T. Hayes, New York’s top Homeland Security official. He was previously the ICE Director of Detention and Removal Operations, in charge of the deportation of illegal aliens around the country. It’s not every day that a federal official at that level files a lawsuit against the head of his agency.

Partners in Harassment/Discrimination: DHS Chief Janet Napolitano & Flamboyant ICE Chief John (Moron) Morton

The lawsuit further elucidates several stories reported on this site about discrimination against straight male Homeland Security officials in favor gay officials, including Napolitano’s girlfriend, Dora Schriro. As I noted, Schriro had zero experience in law enforcement, and yet, she was appointed ICE Policy Director and set the current Obama immigration enforcement policy of not enforcing immigration laws. (Schriro, who made a mess of Arizona’s prisons and empowered violent prisoners against prison guards, is now making a mess of New York’s prisons, a cushy job Napolitano got her so she could be close to a sick relative in New York.)

The suit also contains confirmation of another story I broke on this site, the sexual harassment of male Homeland Security Agents by ICE Chief of Staff Barr, who is known as “Suzy ‘Stripper Pole’ Barr” because Ms. Barr jokes that a building structural support in her office is a stripper pole, and she constantly harasses male agents in the vicinity of the “stripper pole,” including, sources say, dropping items and demanding the agents bend down to pick them up. Barr was brought to the Department of Homeland Security from Arizona by Napolitano and installed as ICE Chief of Staff. She was previously Napolitano’s Chief of Staff in the Arizona Gubernatorial office and has absolutely no law enforcement experience. Agents say that this bimbo, Barr, is the person really running ICE (the Department of Homeland Security’s largest agency), not Obama appointee John Morton, whom Napolitano didn’t want in charge of ICE. The “Fifty Shades of Grey” books ain’t got nothin’ on this pervert-ette. The suit states,

Barr humiliated another male employee by calling that male employee in his hotel room and screaming at him that she wanted ‘his c-ck in the back of [her] throat.

It goes on to say,

Barr covertly took an ICE blackberry [sic] device assigned to a male Special Agent in Charge and set a Blackberry Messenger message to his female supervisor indicating that the male employee had a crush on the female supervisor and fantasized about her. These actions and others . . . were all taken to humiliate and intimidate male employees. . . . Barr promoted and otherwise rewarded those male employees who woulod play along with her sexually charged games including the three male employees whose office she relocated to the men’s bathroom at ICE headquarters.


With regard to Napolitano and her girlfriend Schriro, the suit alleges that Napolitano replaced Hayes with Schriro at meetings and in policy decisions regarding removal of illegal aliens:

Schriro was named as a Special Advisor to Secretary Napolitano on Detention and Removal Operations. . . . Schriro was not as qualified for the position Plaintiff had because of her lack of Federal law enforcement experience. . . . Schriro enjoyed a long standing relationship with the Secretary. Plaintiff believe that he was being replaced in his duties because of this relationship. . . .

Plaintiff was aware that Schriro enjoyed a long standing relationship with Plaintiff’s ultimate supervisor, Secrtary Napolitano, and that Napolitano was promoting Schriro because of this relationship, and not because of any relevant skills, over Plaintiff, who had far more relevant experience in the field.

Hayes’ lawsuit claims that he was repeatedly turned down for and/or jerked around regarding assignments and promotions that he sought within ICE and that this harmed him economically. He also claimed that when he complained about this he was retaliated against. He cites several investigations against him by the ICE Office of Professional Responsibility (OPR) that he claims are trumped up.

I should note that one such investigation involves Hayes’ attendance at a San Diego Padres Major League Baseball game at which Hayes and another ICE official who is apparently his friend, the incredibly sleazy and dishonest John P. Torres (who used ICE funds to get his extra-marital girlfriends jobs for which they were not qualified, etc.), were sitting in box seats. (Torres is now ICE Special Agent in Charge in Washington, DC, because the sleaze and crap at ICE always rises to the top.) Hayes has his share of detractors, and several ICE agents complained to me about this incident, saying that government funds were used so they could fly to San Diego (where they say a convenient, phony “government meeting” was set up as an excuse) and that the box seats were provided to them either free of charge or at a significantly discounted rate, in violation of ICE rules. Hayes alleges in his complaint that he did nothing wrong, that there was legitimate “government business,” and that he was cleared in the OPR investigation.

Regardless of the veracity of either side of that issue, I have heard one thing universally from the many ICE agents and Homeland Security officials who contact me on a regular basis:

That Janet Napolitano and Department of Homeland Security officials running Immigration and Customs Enforcement discriminate against straight male agents (in favor of gay agents) and harass them. And that Suzy Barr constantly sexually harasses male agents in an open, consistent pattern and practice without any negative or disciplinary response from Napolitano or anyone in the Obama administration. (Several agents believe that Obama ICE Chief John Morton is bisexual and that this is part of the reason he allows this behavior and discrimination to continue under his watch. As I’ve noted, the man he appointed to be his deputy, Dan Ragsdale, is openly gay and harasses straight male agents regularly. When John Morton leaves ICE, Ragsdale will be running the show and many agents have questions about their relationship. As I also told you, Morton’s Assistant Deputy is lesbian Beth Gibson, for whom a new, waste-of-money government job was created so she could be near her girlfriend in Colorado, and ICE money was wasted so top officials could attend the girlfriend’s ICE Academy graduation.) All of these Obama officials and their cronies use ICE as their own personal harem, and straight males are the victims.

And this is why so many ICE agents plan to vote for Mitt Romney and cannot wait until the cretinous Obama incompetents running the agency are out. And it’s why, as I’ve repeatedly noted on this site, morale couldn’t get lower at ICE under Obama, and its employees rank it near the bottom of government agencies. The lawsuit’s allegations only confirm that.

This isn’t getting media coverage cuz hey, heterosexual males can only harass women and every one knows they are bigoted against gays.

That’s why apart from this site, don’t look for the media to cover the ICE scandal. What happened to James T. Hayes – well white men can’t be victims, only patriarchal oppressors of women and gays.

Debbie, excellent article and couldn’t have articulated and explained all of the details you published here.

Now could all of you imagine if this scandal within the DHS and ICE happend under a right-wing presidential administration? If something like this happend under a conservative presidency where heterosexual male employees at DHS and ICE sexually harassed thier female co-workers on a daily basis and also did all sorts of verbal abuse and verbal obsecnery towards their LGBT co-workers, the left wing MSM would be on the story like insects on a dead animal. It’ll be all over the news night-and-day, day-and-night and front and center of your local newspaper rag the very next day.

But Norman is right, the left wing MSM won’t touch this story, because this BS is happening under Obama’s watch, not under a Republican presidency, and now wonder this country is melting down from within, the reason is the left wing media, their the ones who’s messing up and ruining this country, not exactly the politicians!

I’m not a labor law attorney,but I hope he filed this lawsuit in a friendly court,because labor laws aren’t written to protect heterosexual employees.

And from what I understand,workplace harassment lawsuits take years to resolve.

And the Obama administration has the backing of the legal system,so I really wish him the best,because all the cards are stacked against him.

    Do I ever think whether the facts in this lawsuit “are true or propaganda”? Always. And although the jury obviously isn’t in on this case, the facts stated have the ring of truth, and to put it more bluntly, I would find it very hard to believe that anyone could even make up such a story. So, “Reader,” you don’t like what Debbie wrote in this article, even though the major media won’t touch it, for the reasons that Norman and Sean articulated, among others? That’s too bad. Stick with MSNBC, if the truth bothers you so much.

    As for the other “critical” issues you feel are not adequately addressed on this website, the reality is that your laundry list is far from critical. Debbie has more than adequately addressed the “rights of Muslims,” and as she has repeatedly pointed out with evidential support, they usually get MORE rights than other citizens, often to the detriment of national security and the rights of non-Muslims.

    As for Romney’s tax returns, I cannot think of anything more than a non-issue than Romney’s older tax returns. The are beyond irrelevant. Don’t you think that if there were ANY issues whatsoever, no matter how minor or mundane regarding Romney’s older tax returns, that Obama and Geitner would be misuing the IRS to investigate and unearth anything they could? Well, they’ve had plenty of time to do that, and they’ve come up with NOTHING. And why is that? Because there IS nothing to be found. Romney may be many things, but he is certainly not stupid, and I sure that neither are his tax attorneys and accountants who prepared his taxes.

    And if you’re naive enough to think that Obama doesn’t misue his office to play politics, perhaps you noticed that an investigation is being conducted into one of Sheldon Adelson’s casinos regarding some allegations of money laundering many years ago. Now, Sheldon Adelson has already given millions and millions of dollars to the Republicans in attempt to defeat Obama. And, in fact, he met with Romney in Israel during a fundraiser.

    Of course, in your Leftist-mind, the investigation into Adelson out of the blue is just a wild coincidence. Well, I’m sure that it must be a coincidence, just like it’s a wild coincidence that absolutely NO investigation has taken place into Jon Corzine, when billions of dollars disappeared at MS Global under his watch. The fact that Corzine is a Democrat must mean that Obama’s failure to investigate was a coincidence according to your “thinking.”

A few observations/points here.

1. I know Jim Hayes; I worked with him on a TDY. Knowing Jim, for him – or for ANY SES for that matter – to file a Federal lawsuit against a political appointee means that a) his buttons must have really been pressed, and, b) he must really, REALLY have the goods on the people named in the lawsuit. For, you see, if he doesn’t win, the filing of this lawsuit isn’t necessarily “career enhancing”, and I know for a fact Jim is too young to retire, so he must be “all in” on this, especially against the likes of Suzy Barr, who can play a pretty mean game of high-stakes political poker herself, and will think nothing of shredding Jim to pieces if he should be bluffing and it is called.

2. People talk about SES and pay. Here is the thing with SESs: It’s not necessarily the pay – it’s the bennies that go with it. SESs, for example, can receive Presidential Rank Awards upwards of $25,000 on top of their pay for exceptional service, and often receive very nice agency bonuses regardless by virtue of who they are and what they do: manage lots of people (sometimes in the 10s of thousands), money (sometimes billions of dollars) and multiple intra- and inter-agency processes. Frankly, they are underpaid for what they do, and would make much more in the private sector (more on that in a moment). They can also accrue up to 720 hours of annual leave and, if I’m not mistaken, unlimited sick leave, and get paid for it ALL upon retirement for unused balances – not a bad little check to take the spouse to Europe or Hawai’i for a post-retirement dalliance. Also, SESs get a paid move to the retirement location of their choice – again, not a bad reward. Now, back to private sector pay: many SESs, upon retirement, cash in their SES resume experience for jobs in the private sector for redonkulous sums of money: John Clark (former SAC Miami) makes mid-six figures working for Pfeizer as head of security for Asia, with paid expense accounts for travel, etc.; Marcy Forman, from my understanding, is making near seven figures working for anti-money laundering compliance for Citigroup and, as rumor has it, Tony Mangione (before his kiddie porn bust) was all but lined up as head of security for the NFL. So, you, see, the SES club is very exclusive, with lots of employment and post-employment benefits, and, by people like Beth Gibson, Erik Barnett and Suzy Barr being effectively swept in to the SES ranks, they are being set up for future successes that most grunt field agents can only salivate over.

3. If you think that favoritism is limited to homosexual incumbents, you couldn’t be more wrong. White males are being increasingly marginalized by the likes of Janice Ayala (AD for Domestic Ops at HSI HQ) and Suzy Barr, who are using their positions to promote females, straight or lesbian, and especially black and Latin females, to choice assignments within the agency to promote an agenda of hate against white males. And this goes on regardless of whether or not the female is eminently qualified or not. Been at HQ as a BF or LF for 3 years while a WM has been there languishing for 5? She’ll get returned to the field to further her career long before he does. Know that SAC job in, let’s say, Houston, that a white male was slotted to get, having already paid his dues? Sorry, that’s going to go to a B or L female with absolutely NO SES experience as her first assignment in the interest of diversity and progress. Know that Master’s program that ICE is paying for? They’ll tell the white male they can’t afford to send him, but they’ll all but drool over the B or L female to apply (with acceptance all but guaranteed) in the interest of “career development”. There is no way a white male can win in this agency, so, what to do? Many I know are now putting in requests for outside employment to open up retail business, do motivational speaking, etc and taking $$$ out of their TSPs to do it. Why? because they know there is no reasonable hope for them of promotion or career development – they are stuck, Stuck, STUCK, and they know the cavalry is not coming to save them. No, to the contrary, the cavalry of black and Latin females is coming to trample them, and, if they don’t fend for themselves and their families, having been discarded afters years of selfless sacrifice, they will be left to the graveyard of irrelevance as their retirement years approach, noone remembers what they have done and they are struggling to live in a post-employment world.

Very, very sad. Good Luck, Jim – you have more balls than many of us scum minions out here, but were rooting for you.

This is VERY relevant, and a blockbuster – this is the equivalent of a Rear Admiral going up against the Chief of Naval Operations or SECNAV – allegations like this being made by a sitting SES against a major political appointee are almost unheard of. As I said, the SES club is VERY exclusive, and Jim is taking a big risk to expose what he believes is a very fundamental wrong in this agency.

If Jim Hayes feels this way, how much more so the grunt minions, who get trampled on every day by behavior like this? The American public should be very concerned that behavior like this has and continues to run rampant, like a 3 ring circus, while morale in the field plummets like the heat shield on the Curiosity rover. And, aren’t we supposed to be the agency dealing with border and national security issues? If agents are otherwise occupied with external pursuits, because they feel they have little if any equity stake in this agency, I think the public should be incensed that mayhem like this is the order of the day, instead of ensuring the good order and security of our nation, and the goods and people that cross its borders.

Debbie most government jobs come down to who you know, who you’re banging, etc. No competency trumps being pals with the boss. I was a White House intern one summer when I was in college. I was a nice Jewish boi back then who showed up on time and did the work. There was a charity event that my office was working on that was going to take place at the VP’s house. I was working on it. Someone in the office casually asked if I, an unpaid intern, wanted to donate money to the charity. I said nein, not realizing it was an entry fee in my case. I was soon informed that I was not going to the function. The other intern, a pretty blonde girl, got to go. My supervisor was a fat, nasty bitch, but she was an alleged close personal friend and former neighbor of the VP’s wife. People walked on egg shells around her. I learned I would be better off self-employed, B’H.

    If you truly get your information from many different websites and writers that’s good. What I fear is that many of the particiapants on this website just listen to what others like Debbie are saying. That’s what I am afraid of. Being more liberal in nature I try to hear from both the left and right. In fact, at one time we had moderate Democrats and moderate Rebulicans who didn’t just go by whatever the party says. Some Democrats were liberal on some issues and concertative on others, vice – versa for Republicans. I wish we could get back to that.

    As you have a saying about “A Culture is Defined By it’s Border” My motto is “That an educated person evaluates what he/she reads, or hears on the radio or Television and makes up a mind for themselves”.

Reading this article and all the posts attached to this leaves one with the feeling of disgust for what has happened to this agency. I have no care whether one is straight, lesbian, gay or bi. What I do care for is the ICE mission and the oath I swore to uphold – and the systematic unraveling of immigration enforcement brought about as a result of the political pandering that has gone on with this administration for the last 3.5 years.

I am amazed at the incompetence and the arrogance of those leaders within the Office of the Director who should be leading ICE and enforcement initiatives into the future to protect this country as opposed to dismantling law enforcement and promoting a particular social agenda and practicing cronyism with friends lacking the qualifications to perform work to an appripriate level of competence. These people have done so much damage to the agency and to the country. And this administration has done much to make ICE the laughing stock of the law enforcement community. Of course immigration enforcement is broken – administration after administration have done everything possible to destroy it – only the current one held back nothing in the process.

With regards to Hayes allegations re: the GLBT issue and favoritism – Please do not think that this BS or something similar has never happened before now. It has – the arrogance – and the inappropriate sexual relationships that have occurred with arrogant slimes like John Torres who had an inappropriate relationship with a woman he tried to hire for Kansas, the former Director for OIA and his subordinate who traveled together all over the world in business class, and this truly ‘stellar’ example of leadership – Jim Hayes – who abused travel, slept with subordinates, and beat up and destroyed the lifetime careers of any and every individual who dared question him or disagree with him. This evil PoS has had so many complaints filed against him because of his continued mistreatment of employees. Many of the allegations against him were pending long before the lunatics in the Directors Office arrived.The retaliation, cronyism, fraud, waste and abuse under his leadership would probably make many of the GSA scandals pale in comparison. I think if DOJ put up a ‘sign up’ list for those Hayes victims willing to testify – it would take months for the trial to finish. Trust me – they would not be found ‘not credible’.

I hope the government doesn’t give him one penny. He is no hero. He is an evil piece of sh*t and has earned this. Had his mentor Torres not been there to protect him – he never would have gone as far has he did in his career….. and hopefully – he will soon be relegated to the same banishment and denigration he has imposed on so many of his own employees.

We know that the Obama machine is merciless in going after its critics — even a liberal like Romney is shown no mercy — although he is a true moderate, the Obama machine is going after him with made up charges and lies, and as Ralph Adamo pointed out, the federal harassment of Adelson at this particular time is not an accident.

We have known for a long time that DHS and ICE monitor this site, and are alert to any efforts to discredit their sick and dishonest leadership. I’m surprised it took them as long as it did to come up with belugajedi’s ‘contribution’. It is a little more sophisticated than the previous ICE contributions, but in essence it is the same.

After a few distracting, non-specific and pro-forma digs at ICE, general allegations that will do no damage, this person gets down to the real point of his post, i.e. to discredit Hayes.

But as StillShakingMyHead points out, Hayes stands to lose a great deal if he cannot back up his assertions. He, unlike belugajedi is specific, and willing to take risks to substantiate his charges.

And not one word by belugajedi about the merits of the suit. You can be a scoundrel and still be telling the truth in your lawsuit. Can belugajedi refute Hayes’ charges?

Hayes is not perfect, and, no doubt, his enemies, supported by the mafia-like administration, will try to bring up belugajedi’s charges during litigation, to try to discredit him, and dismiss the case. There is no concern on their part whether the charges are relevant to the suit or not, or even whether they are true or not. We have already seen during the past week, and in previous episodes, e.g. with Herman Cain, that this is not how these people work.

belugajedi is actually setting up a roadmap for how the defense should proceed, and alerting us to their probable strategy — don’t deal with Hayes’ actual charges — just bring up ‘witness’ after ‘witness’, like they did with Cain, so the charges, themselves, cannot be weighted objectively. Try to destroy Hayes before he gets a chance to substantiate what he is saying.

Did you read this article and the Complaint? If what you said were true in even the slightest regard, then surely defendants would not have just investigated Jim Hayes and those allegations made against him, but they would have shown SOMETHING to hang their hats on against him by now.

Furthermore, you can be absolutely sure that many other employees aspiring to climb the political ladder would be more than willing to volunteer anything they could to discredit Hayes. I’m sure Barr & Co. have made it clear that a quid-pro-quo policy is unofficially in place to encourage all forms of attacks on him. Whatever could stick, whether true or not would be more than welcome, I’m sure.

As noted in the Complaint, the defendants worked very hard–probably harder than they’ve ever worked in their lives (which might not be saying all that much)–to discredit and nail Hayes, but they came up with absolutely NOTHING. What part of NOTHING don’t you understand?

By the way, nothing in this lawsuit requires that Jim Hayes be proven to be a sweetheart boss who’s soft on his employees. Whether or not his case has merits does not turn on any findings about that.

This is more evidence of a federal bureaucracy full of waste, fraud and mismanagement, and the culture of federal agencies. A 30-50% reduction in forced over the next ten years is the only answer. We don’t need 60+ federal law enforcement/investigative agencies fighting for turf and budgets. Get rid of the duplication. HSI should be the first to go. ATF the next. Many more need to follow.

Another couple of points/observations:

1. In the brief time I worked with Jim, I found him to be tough, and a man who did not suffer fools. That said, he was fair (at least to me, anyway) and he tried to help me where and when he could. Of course, it didn’t hurt that, when I disagreed with him, I didn’t take him to the woodshed publicly and embarrass him. You think Jim Hayes is tough, I worked in the private sector (financial and retail), and he ain’t nothing compared to some pricks out there, who would strip you naked, skin you alive, roast you and put your remains on public display, all for sneezing the wrong way.

2. More importantly, in an era of fiscal austerity – where downsizing of agent ranks is now a probability than just theory, cars are being parked because there’s no money for gas or repairs, investigative travel is regularly denied due to lack of money, annual bonus money has been slashed almost 65-75 %, etc., isn’t anyone curious how we can justify the elevation of people to nebulous positions at the rank of SES, with all the associated costs? If I were Congress looking at this article and this lawsuit, I’d be calling for hearings in fairly short order to sort out this foolishness. The fish rots from the head down, and the only way to rid a snake is to go for the head – where is the accountability here? I see agents being written up for so much as putting premium gas in their GOVs (by accident, I might add), but nonsense like this gets a pass without so much as a raised eyebrow. Again, this is why many agents, especially white males, are adopting a bunker mentality – doing the bare minimum, seeking outside employment opportunities, and making this agency and its work the furthest, rather than the FOREMOST, thing on their mind when they wake up in the morning.

Any way you slice it, this is a whiny, pussy move from a marginally competent guy who didn’t get his way. Hayes had a meteoric rise to the top. He didn’t complain when he benefited from politics, cronyism and favoritism. He didn’t hesitate to use these tactics against others. But now that he and his crew of knuckleheads are no longer calling the shots, he sues like a bitch.

Let me tell you what’s gonna happen and you can take this to the bank: nothing. Hayes and the spineless lawyers of OPLA will cluster around the settlement table and rub balls. They’ll agree on a number and you’ll never hear another word about it.

Just another day in ICE, the agency programmed for failure.

I never liked Hayes, but at least he has the balls to bring to light the constant bullshit that goes on at HQ. Yes, he had a fast rise to the top, as did many INS types during the merger of INS, Customs and other agencies into DHS. But wrong is wrong, and I am glad he’s exposing the assholes for what they are.

Your own evaluation should be limited by the average of the entire office’s evaluations. If everyone you supervise sucks, then you, as a leader, suck. Government SES employment is based upon who you know. Period. There are no standards other than your black, your Hispanic, you gay, your a pervert, etc. Patronage, politics, cronyism, etc.

Anyone who has worked for any government organization knows this.

Based upon my anecdotal previous government work experience if your supervisor is a pervert then you will be either knuckling under and get jerked around or you fight it and get nowhere in your job. If you have a good supervisor then you are damn lucky, which is incentive for you to hold on to your job, because you are not getting jerked around.

There is so much perversion in the government that it may be the primary function of government to promote a perverted lifestyle in a work environment.

This article and Jim’s lawsuit are enormous in impact. I hope Jim can get a court to address the facts. Unfortunately, his case will be influenced by the agency he is in. His fight is uphill all the way.

I stayed in as long as I could to retain my character and support my family. 13 years.

Somebody, in an earlier post, nailed it when they said that ACE didn’t mind when he was benefitting from his “close relationship” with Pumpkin Head. Passing up numerous more qualified ERO employees in order to select his alcoholic friend ACE. ACE is the king of hostile work environments. He took it to an entire different level. All ICE has to do is bring up just a few of the hundreds of good employees that ACE f-ed with and they will tell a jury just what a motherf-er ACE is. Alcoholic Jimmy sitting at his computer at home…beer in hand…getting his “degree” from the on-line diploma mill, “Park University”. The guy is a joke, a clown and a despicable human being. If there is Karma, and God I hope there is, little Jimmy, aka: Purple Hayes, ACE, will have a thorny tree fall on him while he is being struck by lightning and rabid gerbils will rip his eyes out while he is dying.
