WTF?!: Dearbornistan Jury Requires Terry Jones to Pay “Peace Bond” to Hold Protest; Bond is $1; Jones Refuses to Pay, Arrested!

It’s official.  We’ve lost America.  A Dearbornistan jury just found (at about 6:42 p.m.) that Pastor Terry Jones must pay a “peace bond” of thousands of dollars in order to hold his planned protest in front of the Islamic Center of America mosque in Dearbornistan. But District Court Judge Mark Somers charged Jones only $1 in bond, which he’s refused to pay, and has now been arrested and put in jail. Huh? I told you Jones wanted to be a martyr. But he shouldn’t even have to pay $1. Free speech is free, thus the adjective in front of the word, “speech.”

As I write this, it is just over two hours AFTER the time that Jones was to hold his protest, but, instead, he’s been on trial for prior speech and future speech in one of the most unconstitutional trials I’ve ever seen (I watched much of it on live feed broadcast over the net).  The protest was to take place at 5:00 p.m. Eastern, today, and now that won’t happen, as the judge, Judge Mark Somers, just returned to set the amount of the bond. He set it at $1, which Jones refused to pay, so he’s been arrested and put in jail.  The whole thing is one humongous outrage.

Jones had said he would come back and hold his protest, originally planned for today, next week.  And, again, it’s clear to me, he just wants to be a martyr.  Neither he nor a colleague from his church who was also on trial today wanted to poll the individual members of the jury.  The judge repeatedly offered them to preserve several objections for appeal,  appeals they likely would have won, ultimately.  But they declined each time.  They didn’t want to win this.  They just wanted to be martyrs, and it sets a bad precedent for the rest of us. And with their refusal to pay even the $1 bond, that’s clear, even if it is out of principle. Still, they shouldn’t have been required to pay one red cent. And the fact they were arrested for refusing to pay is an outrage. I wish I could represent them, but alas, the Jewish Sabbath is about to start for me.

Regardless of the small amount of bond the judge imposed, it’s a very sad day in America that there was a trial at all, and more so, that a jury said you have to pay for the privilege of exercising your First Amendment speech rights if you burn a Koran.  Say good-bye to our freedoms, slowly but surely. Free speech is no longer free, even if a judge says you only have to pay $1.

I would never pay such a bond. Not even a $1. I would tell the judge to stuff his unconstitutional authority where the sun don’t shine.

And I’d happily go to jail out of principle. My rights are not for sale by our government.

John, speaking of the ACLU, the ACLU to their own credit (I’m no fan of the ACLU) came to the aid of some guy in New Jersey who last summer burned a few pages from the koran (some of the folks call the koran hateful) and was fired a day later. Guess what, that same guy who lost his job from the NJ Transit got his job back today and the ACLU came to his defense and said that the NJ Transit was wrong for firing that guy because he exercised his 1st amendment rights. So it’s not quite a bad day in this country, yes Mr. Jones had to pay a bond to demonstrate infront of that koran-thumping-fanaitcal mosque but on the flip side, a guy in NJ got his job back despite burning a few pages from the koran.

The behavior of the Dearborn police and especially this judge (who in this role is also in charge of the jury and the instructions given to it) are so egregious that it is entirely possible that they might lose any defense of qualified immunity, should Jones decide to sue them civilly, on the basis that they have violated Jones’ clearly established constitutional rights. This would proceed from the USSC’s 1982 Harlow v. Fitzgerald decision.

I do realize the judges ordinarily are given absolute immunity when acting in their official capacities, but how could these rulings ever be considered official since they depart so drastically from established law in these areas.

    The Civil Rights Act Of 1866 prohibits government officials from depriving a citizen of his rights under the color of law.

    Jones has a very good legal case here and he’d probably win it. But our officials are afraid of offending Islam.

    It doesn’t matter whether or not he presses a claim. Islam is just too politically correct for any one to go near it.

Jones paid the bond. Judge imposes 3 year ban on protest. Will amend ban if mosque imam agrees. So, constitutional rights now subject to discretion of religious figures. This judge just annulled the constitution and the bill of rights.

Those areas include the front steps of city hall. He refused. He only wanted to be in front of the mosque! Wonder why???His messages are all about hate for others unlike himself.     Jews can keep Nazis out their neighborhood or from demonstrating in front of the synagogue because private institutions and individuals don’t have to associate with or hear any one they don’t like. That kind of prior restraint is perfectly constitutional and appropriate.

    All the Constitution forbids is the government from imposing prior restraint on free speech. Its one thing if the mosque wanted to keep Jones off its property. That’s its right. What’s wrong is the government has no business censoring any one even for what seems like a good reason. That is why we have the First Amendment.

You miss the point of a protest. Union members protest legislation at the State Capital. Pro-Life people protest outside of abortion clinics. How could Terry Jones protest Islamic violence at City Hall? City Hall is not (or should not be) a symbol of Islam. That is why he wanted to be in front of a mosque. He chose Dearborn because it’s the largest in the US.

As to your point of how would it feel to have others protest your religion, this is routine to Christians. In art, the crucifix has been desecrated in all manners (think ants, urine). In music there are numerous examples of disrespect and attack (think Madonna , Lady GaGa). In film you have the dumb, southern Baptist, corrupt, minister and the pedophile priest. There have been many books and movies exploring the theory that Jesus was a hoax (think the DaVinci Code). Gay activists attack Christians and Church leadership for their stance on homosexuality. With so many examples, I’m not sure why you think we should fear “you could be next”? So many others have already been there.

I, too, am a mother. I teach my children that they are responsible for their own actions. My 5 year old got in trouble at school for hitting another student. It did not matter what the other child said or did, my child needed to control his anger and was punished by the school (no recess).

There will always be someone who says or does something that another finds offensive. We have all been guilty of offending, intentional or unintentional. As adults we should be able to handle that offense without violence or destruction. Why can’t we expect the Muslims of Dearborn to control their actions and react peacefully?

Why is it my 5 year old is held to a higher standard than Muslim adults?

Sad, sad, sad that 1) a jury would say one needs to have a bond for “possible riot” by miscreants, and 2) a judge feels sanctimonious for lowering the bond to one dollar. I bet A.N.S.W.E.R and CODE PINK do not get these requirements when they have their protests.

Pastor Jones may be extreme, and showing poor judgement in past, but in USA he did not break any law.

    Burning books or burning flags may be juvenile behavior but the Supreme Court has held desecrating revered symbols amounts to sending a constitutionally protected message.

    Unless its Islam and then all of a sudden we’re told we can’t offend them. I call it the Great Exception to the First Amendment.

As I understand it, the reason Pastor Jones and his associate were being charged a ‘peace’ bond was so that those two folks would not, themselves, riot and create damage.

Sure, two guys against an entire MoMob. Uh, huh.

The truth, of course, is that it would have been Muslims doing the rioting!

But not only were those most likely to riot not required to post such a bond, so-called Muslim leaders gave their assurances (which they have no authority to enforce) that–because Muslims love America and freedom of speech–‘the Muslims’ would behave. But, let’s be honest, who of ‘the Muslims’ would have been responsible to provide such a bond?

But why, then, would Jones have needed to post a $1 bond in order to receive the permit he sought, and why was he jailed for refusing to accept that burden? As they say, what’s up with that?

A lot of things ain’t adding up here.

I, too, think Jones may be crazy like a fox, and I hope he files an appropriate law suit; not merely to seek redress of the grievence caused by having his right to freedom of speech denied, but to shine a bright light on the favoritism and bias toward Islam by our supposedly secular legal system.

Woh, boy. Looks like the trolls have discovered Debbie and are worried enough to spend their afternoons dropping excrement on her site.

I wish we’d all stop saying we disagree with Jones or that he’s a jerk. The act of burning a book is ho hum. It is NOT a sacred relic just because some 7th-century minded misguided folks consider it so. The two giant Buddhas that cannot be replaced, that were thousands of years old, are one thing. A book that is mass-produced and in a language most people don’t even read is not (not to mention the fact that it’s a book of hate supposedly be someone who sounds like a sociopath.)

The military tells Gitmo guards to handle the koran with gloves and “with reverence.” WHAT? I don’t “revere” that book, and I’m sure our soldiers don’t either. It’s just another case of buying into muslims shit.

Enough. If they want to buy into our system, MAYBE. if they have something special to offer and show they’ve left their hate (including giving money to terrorists) behind, MAYBE we’ll agree. But as long as they keep up this “Honor what we honor or die,” we don’t need ’em.

Chris Christie’s dhimmihood has destroyed any chance he ever had of a presidential run. People here are truly sick of this.

    The feelings of savage murderers would be hurt by our words? I didn’t know Islam took an affront to indelicate language.

    If you have seen how they can mutilate and gut a human being, well there is no language to describe it.

With this ruling which should be overturned, it proves that the city officials are scared to death of the savages within. I am also reminded of the saying which is proving to be rather prophetic, silence our voices and the next thing you will hear will be the sound of our rifles.

I don’t think the ruling is going to be overturned. Remember, the rule is different when it comes to Islam.

Dear Debbie,

Terry Jones is fighting fire with fire. What did Patrick Henry say…”give me liberty or give me death”? This is the attitude we have to have as Americans when you are fighting these Islamists and their brainwashed dhimmis. Unless you put your butt on the line and protect Free Speech it will be lost to the entire West.

My dearly departed grandfather (who survived the Nazi and Soviet Invasion of Poland in 1939 and WWII in the far east) once summarized to me his war time experiance: that people will sell their liberty for the price of a cheap whore. This is evident of the court and the ruling of the judge and jury. What an obscene unconstitutional travesty–a show trial. May they all be cursed.

DH: No, actually, he didn’t fight at all. He didn’t have a lawyer and did all of this to become a martyr and raise more money in a bigger lawsuit he will now file with the most inept, fradulent bunch of lawyers ever, the Thomas More Law Center. He could have defeated this with a real lawyer, had he chose. But he wanted to turn this into martyrdom and fundraising for himself, and he succeeded. DS
