EXCLUSIVE: Top NY Homeland Security Cop Sues Napolitano; Alleges Obama DHS Officials’ Anti-Straight Discrimination, Demands for Oral Sex – “J-No Appointed Lesbian Girlfriend, ICE Chief of Staff Harassed Male Agents”

New York’s top Department of Homeland Security cop is suing Department of Homeland Security Chief Janet Napolitano in an explosive but heretofore unnoticed federal lawsuit alleging Homeland Security employment discrimination against straight male agents by Napolitano (READ the federal complaint) in favor of her lesbian girlfriend and sexual harassment of male agents by Napolitano’s handpicked Immigration and Customs Enforcement (ICE) Chief of Staff, Suzanne Barr. The lawsuit alleges that Barr demanded a male ICE Special Agent engage in oral sex with her and that she relocated three top male ICE agents’ offices to the men’s bathroom at ICE headquarters. All of the alleged misconduct was the behavior of Barack Obama’s hand-picked people running the Department of Homeland Security, who’ve created a hostile work environment for straight male agents, a story I recently broke on this site.

Many of the key allegations are stories I’ve broken on this site over the years, and the federal civil rights lawsuit gives more details. The 21-page federal federal complaint was filed in late May by New York Special Agent in Charge of Immigration and Customs Enforcement (ICE) James T. Hayes, New York’s top Homeland Security official. He was previously the ICE Director of Detention and Removal Operations, in charge of the deportation of illegal aliens around the country. It’s not every day that a federal official at that level files a lawsuit against the head of his agency.

Partners in Harassment/Discrimination: DHS Chief Janet Napolitano & Flamboyant ICE Chief John (Moron) Morton

The lawsuit further elucidates several stories reported on this site about discrimination against straight male Homeland Security officials in favor gay officials, including Napolitano’s girlfriend, Dora Schriro. As I noted, Schriro had zero experience in law enforcement, and yet, she was appointed ICE Policy Director and set the current Obama immigration enforcement policy of not enforcing immigration laws. (Schriro, who made a mess of Arizona’s prisons and empowered violent prisoners against prison guards, is now making a mess of New York’s prisons, a cushy job Napolitano got her so she could be close to a sick relative in New York.)

The suit also contains confirmation of another story I broke on this site, the sexual harassment of male Homeland Security Agents by ICE Chief of Staff Barr, who is known as “Suzy ‘Stripper Pole’ Barr” because Ms. Barr jokes that a building structural support in her office is a stripper pole, and she constantly harasses male agents in the vicinity of the “stripper pole,” including, sources say, dropping items and demanding the agents bend down to pick them up. Barr was brought to the Department of Homeland Security from Arizona by Napolitano and installed as ICE Chief of Staff. She was previously Napolitano’s Chief of Staff in the Arizona Gubernatorial office and has absolutely no law enforcement experience. Agents say that this bimbo, Barr, is the person really running ICE (the Department of Homeland Security’s largest agency), not Obama appointee John Morton, whom Napolitano didn’t want in charge of ICE. The “Fifty Shades of Grey” books ain’t got nothin’ on this pervert-ette. The suit states,

Barr humiliated another male employee by calling that male employee in his hotel room and screaming at him that she wanted ‘his c-ck in the back of [her] throat.

It goes on to say,

Barr covertly took an ICE blackberry [sic] device assigned to a male Special Agent in Charge and set a Blackberry Messenger message to his female supervisor indicating that the male employee had a crush on the female supervisor and fantasized about her. These actions and others . . . were all taken to humiliate and intimidate male employees. . . . Barr promoted and otherwise rewarded those male employees who woulod play along with her sexually charged games including the three male employees whose office she relocated to the men’s bathroom at ICE headquarters.


With regard to Napolitano and her girlfriend Schriro, the suit alleges that Napolitano replaced Hayes with Schriro at meetings and in policy decisions regarding removal of illegal aliens:

Schriro was named as a Special Advisor to Secretary Napolitano on Detention and Removal Operations. . . . Schriro was not as qualified for the position Plaintiff had because of her lack of Federal law enforcement experience. . . . Schriro enjoyed a long standing relationship with the Secretary. Plaintiff believe that he was being replaced in his duties because of this relationship. . . .

Plaintiff was aware that Schriro enjoyed a long standing relationship with Plaintiff’s ultimate supervisor, Secrtary Napolitano, and that Napolitano was promoting Schriro because of this relationship, and not because of any relevant skills, over Plaintiff, who had far more relevant experience in the field.

Hayes’ lawsuit claims that he was repeatedly turned down for and/or jerked around regarding assignments and promotions that he sought within ICE and that this harmed him economically. He also claimed that when he complained about this he was retaliated against. He cites several investigations against him by the ICE Office of Professional Responsibility (OPR) that he claims are trumped up.

I should note that one such investigation involves Hayes’ attendance at a San Diego Padres Major League Baseball game at which Hayes and another ICE official who is apparently his friend, the incredibly sleazy and dishonest John P. Torres (who used ICE funds to get his extra-marital girlfriends jobs for which they were not qualified, etc.), were sitting in box seats. (Torres is now ICE Special Agent in Charge in Washington, DC, because the sleaze and crap at ICE always rises to the top.) Hayes has his share of detractors, and several ICE agents complained to me about this incident, saying that government funds were used so they could fly to San Diego (where they say a convenient, phony “government meeting” was set up as an excuse) and that the box seats were provided to them either free of charge or at a significantly discounted rate, in violation of ICE rules. Hayes alleges in his complaint that he did nothing wrong, that there was legitimate “government business,” and that he was cleared in the OPR investigation.

Regardless of the veracity of either side of that issue, I have heard one thing universally from the many ICE agents and Homeland Security officials who contact me on a regular basis:

That Janet Napolitano and Department of Homeland Security officials running Immigration and Customs Enforcement discriminate against straight male agents (in favor of gay agents) and harass them. And that Suzy Barr constantly sexually harasses male agents in an open, consistent pattern and practice without any negative or disciplinary response from Napolitano or anyone in the Obama administration. (Several agents believe that Obama ICE Chief John Morton is bisexual and that this is part of the reason he allows this behavior and discrimination to continue under his watch. As I’ve noted, the man he appointed to be his deputy, Dan Ragsdale, is openly gay and harasses straight male agents regularly. When John Morton leaves ICE, Ragsdale will be running the show and many agents have questions about their relationship. As I also told you, Morton’s Assistant Deputy is lesbian Beth Gibson, for whom a new, waste-of-money government job was created so she could be near her girlfriend in Colorado, and ICE money was wasted so top officials could attend the girlfriend’s ICE Academy graduation.) All of these Obama officials and their cronies use ICE as their own personal harem, and straight males are the victims.

And this is why so many ICE agents plan to vote for Mitt Romney and cannot wait until the cretinous Obama incompetents running the agency are out. And it’s why, as I’ve repeatedly noted on this site, morale couldn’t get lower at ICE under Obama, and its employees rank it near the bottom of government agencies. The lawsuit’s allegations only confirm that.

      Absolutely! Succinctly put, that is exactly what HSI has become, a giant bumbling, inept, inexperienced, BS federal agency that has been populated by “hand picked” Clowns that have nothing else to do but whine and cry all day about any perceived affront to them. And, No, hell no they are not going to leave, where else in a federal “law enforcement” (term used loosely to describe HSI) is an “agent” going to get an automatic 13 and above without any heavy lifting as in experience and knowledge, and actually doing the job of a “criminal investigator”? That’s what the job description demands. HSI agents are getting the same pay as FBI and others while producing 1/100th the work load, processing aliens and then releasing them doesn’t count. And, no experience and competence is expected of the Clowns!

      Just like everything else about HSI, it sounds very good, very tough, in writing, and it’s a cool job because you get to carry a badge and a gun (chicks dig it!) In reality it has been transformed into an emasculated, ball-less, fake tough guy/girl of an agency, and what role models! Clowns.

The latest average wage index for the United States, reported by the Social Security Administration, is $41,673.83 per year.

The average salary of a special agent at U.S. Immigration and Customs Enforcement, reported by glassdoor.com, is $109,220.

If you aren’t happy working for ICE and feel you’re entitled to more money/a higher position, leave.

A lot of people in the U.S. would like to earn your pay…and would be disgusted with your sense of entitlement.

I appreciate your sense of altruism, but please spare me your disingenuous BS.

People are pragmatic, and do and will act in their own best interest – this includes you.

In a time of no COLAs, no promotions, increasing health insurance premiums, etc., the only thing that matters is family and caring for them and their future. No one is going to stand by and watch their hard work be ignored. Many agents are very smart and driven people and, if the economy didn’t suck, these same people taking $$$ out of their TSPs may already be in the private sector (and still may leave government if the economy improves sufficiently enough). That said, all that will be left in HSI 5, 10, 15 years from now are the otherwise unemployable (cartons and buffoons).

Your self-righteous indignation may work with others, but I don’t buy it, not for a microsecond.

I’m glad you pointed out that Hayes himself is not necessarily an innocent victim in all this. Just how bad this agency has gotten is that now it appears that even the corrupt officials are complaining about the corruption, that’s funny and sad.

Jim Hayes was promoted well beyond his abilities and its ludicrious he is filing a law suit. He also has a history of being intolerant of lesbians as evidenced by his ugly speech and actions to several women in HQs who engaged in alternative lifestyles. But thanks to people like his buddy the sleezy JT he suffered no reprisals but was promoted. Last year he showed up in Madrid for an IPR conference which could have benefited a working agent as his only agenda was to go out tapas crawling with Morton who spends all his evenings drinking and pathetically trying to pick up women. The only leader with any remaining ethics and moral compass is Jim Dinkins but he also has succumbed to the tempation of promoting his boys. I used to think they would have to kick me out of legacy Customs, the minute I hit my 25 I was out of ICE.

Correct? What were your qualifications? How many people had you supervised at that point in your career? 10? 6? Yet, Mr. Torres selected you. The score sheet from that interview panel is widely available. Mr. Torres selected you even though you were ranked the 9th out of 9 candidates. Mr. Torres even ranked your knowledge of DRO as the lowest. Yet, you got the job. I guess that wasn’t a hostile work environment for you was it? What about the 8 DRO candidates that were passed over? Was that a hostile work environment for them? After causing nothing but havoc in that office…showing up at 1000 every morning because you were hung over…you were”’selected” for a detail in HQ by Mr. Torres. I think you racked up a record number of EEO complaints in Los Angeles. Great Job Jim. Getting out of Los Angeles just in the nick of time. You were detailed as the Acting Assistant Director for Enforcement for the old DRO program. While there, you orchestrated the demise of a well-seasoned DRO employee and had her removed shortly before the end of her Senior Executive Service probationary period. This employee, by the way, had been enticed to D.C. by none other than Mr. John Torres. After destroying her career, you set your sights on bigger and better things. At this point, I think, Mr. Torres realized that he had made a mistake but, he had created a monster. Your undeserved, meteoric rise continued. You announced your ascension to the Director of the DRO program sometime in October of 2008. Everyone was thrilled. I can’t really say that I have much sympathy for Mr. Hayes for the following reasons:

He seems to have had quite a meteoric rise in the agency from his beginnings as a BPA (probably GS5 or 7) in 1995 to a GS-15 only 10 years later. Having only about 2 or 3 years experience as a criminal investigator street agent in INS he subsequently became Special Agent In Charge of Homeland Security Investigations New York.

Apparently, he began filing EEO complaints in May 2011 when he was not selected for the position of Special Agent In Charge Los Angeles and his lawsuit seems stem from that event.

While the allegations of favoritism and sexual harassment might very well be true, I wonder if any of these allegations are contained in his EEO filings.

Even if they are contained in the 2011 EEO complaint, why did it take so long. The reported events of discrimination and sexual harassment took place in 2009, some 3 years ago. If this GS-15 Manager had really been offended by that activity, why did he not take appropriate action at that time to report and curtail the activity.

I might be a little cynical, but in my opinion Mr. Hayes was probably perfectly fine with things as they were until he didn’t get the position he wanted.

This is of course just my opinion, and you know what the old adage says about opinions. I’m just glad that I retired prior to the formation of the HSI/CBP monstrosity.

This is one the reasons I left DHS/Customs and Border Protection. It harbours a culture that is rooted in a high-school mentality and immature behavior. An inordinately high percentage of DHS staff is composed of 20-something year olds who hold positions they are unqualified for, and who lack the experience and maturity to conduct themselves in a professional manner. This immature youth-culture is pervasive throughout all of DHS, and it appears to be promoted by management throughout all the component organizations to the detriment of older, seasoned career professionals, law enforcement and otherwise. This is why DHS is still viewed as an illegitimate “facade” agency. It tries to give itself the appearance of doing valuable security work, when in fact it is merely a directionless playground of the immature who pretend to be “security” experts and secret squirrels. It’s really a big joke.

I am stunned by Mr. Hayes’ accustaions when he specifically promoted those who were his friends and in fact promised them promotions to supervisory positions before the announcement if they left D.C. with him and went to NY. These were his subpordinates….severa levels down, but he still promoted them over those their senior….and in every case, his tendency to promote was a a caucasian male. Just take a look at the amount of nominees available for him to promote during his tenure and break it down by race, gender and see what he did.

I am disgusted by the way these holier than thou bureaucrats carry on. CXBP has been harassing me for over a year, sending me every time I have flown into the US from another country since July 2011 for secondary searches. I’ve missed scores of planes, lost a girlfriend, etc. I have never been arrested for anything. Recently they’ve taken to stopping my small boat returning from the Bahamas for hours-long searches intended to intimidate. I cannot believe this is the United States. I’ve hired 2 different lawyers who have achieved absolutely no improvement in treatment for me. I am seriously considering relocating to another country. This can’t be the US of A, can it? What can be done about this stuff?

I happened upon this site when I realized my cousin who I haven’t been in contact with in many years was named as a top ICE official. Imagine my dismay to read this site and the homophobic, racist, comments by supposed former ICE agents. As a former federal government employee, these posts are disgrace to the thousands of hard working individuals who do not engage in this type of distasteful banter, especially those in law enforcement. What does Napolitano’s or Morton’s sexuality have to do with anything except a need to bash people personally because you cannot formulate legitimate arguments about the true issues at hand… Morton, Dinkins and others certainly need our support instead of the rants of disgrunted former employees. Whenever I read these types of homophobic and racist rants like those featured on this site, I realize how scary it is that people like you were once in government, or still are, let alone carrying a weapon. I am sure if you disagree with me, you can say I am a pro Islamic lesbian and that will make it all ok.
