Muslim Judge Protects Muslim Who Choked Atheist: Story Ripped Off by WorldNutDaily

By Debbie Schlussel

For years, I’ve warned about the dangers of Muslim judges in America.  They are not loyal to U.S. law and they use it to protect Muslims and their interests against the rest of us.  I’ve cited, for example, the Hezbollah Judge in Dearbornistan Heights, Michigan (and there are many others like him).  For the past couple of days, a number of readers have sent me an excellent piece of news coverage by Al Stefanelli of American Atheists, about how a Muslim judge in Pennsylvania dismissed with no basis a case against a Muslim who choked an atheist, and then he lectured the victim about the greatness of Islam, agreeing with the choker and taking a position against the victim’s First Amendment free speech rights. Using a position of authority to promote and side with Muslims over non-Muslims is a form of sharia, Islamic law.

Say Good-Bye to Civil Rights Under Islamic Judges in America

Sadly, as is usual with the frauds and thieves at WorldNutDaily, the story was completely ripped off–almost word for word–by plagiarist Chelsea Schilling at WND (who “edits” fellow plagiarist Jerome Corsi‘s BS newsletter).  Don’t read or forward her link.  This woman has no shame and would clearly steal your wallet if she had the chance.  Go to Al’s original story to get the details that the fraud Schilling ripped off.  (Everything at WND is either fabricated or just stolen, including a lot of my original work which the unethical lowlife Joseph Farah instructed his writers and editors to rob from me.)  Here is a video and an excerpt of Al Stefanelli’s original, since-plagiarized work, about how we are losing our civil rights and freedoms to Muslims in positions of power on our own shores:

The Pennsylvania State Director of American Atheists, Inc., Mr. Ernest Perce V., was assaulted by a Muslim while participating in a Halloween parade. Along with a Zombie Pope, Ernest was costumed as Zombie Muhammad. The assault was caught on video, the Muslim man admitted to his crime and charges were filed in what should have been an open-and-shut case. That’s not what happened, though.

The defendant is an immigrant and claims he did not know his actions were illegal, or that it was legal in this country to represent Muhammad in any form. To add insult to injury, he also testified that his 9 year old son was present, and the man said he felt he needed to show his young son that he was willing to fight for his Prophet.

The case went to trial, and as circumstances would dictate, Judge Mark Martin is also a Muslim. What transpired next was surreal. The Judge not only ruled in favor of the defendant, but called Mr. Perce a name and told him that if he were in a Muslim country, he’d be put to death. Judge Martin’s comments included,

“Having had the benefit of having spent over 2 and a half years in predominantly Muslim countries I think I know a little bit about the faith of Islam. In fact I have a copy of the Koran here and I challenge you sir to show me where it says in the Koran that Mohammad arose and walked among the dead. I think you misinterpreted things. Before you start mocking someone else’s religion you may want to find out a little bit more about it it makes you look like a dufus and Mr. (Defendant) is correct.”

Read the rest of this very disturbing story. And don’t patronize the thieves at WND for their BS robbery of what’s been done.

Keep this disturbing story in mind the next time the ACLU and liberal judges tell us our concerns about Sharia are all irrational and made-up “Islamophobia.”

The Religion Of Peace wants its laws to take precedence over ours so they can take away our rights – just like they do in Muslim countries.

And as with everything else in America, we allow them to get away with it and this happened in PA.

Its not a good sign.

NormanF on February 24, 2012 at 8:53 am

Right on, Norman. We all know that the ACLU comes out strongly to protect the rights of Nazis, Skinheads, and KKKers to demonstrate and air their poison, even though all civilized people are offended by their rantings. But here, when you have an athiest airing his viewpoint, the ACLU is just fine with him being attacked and in violation of his free speech rights. Why? Because the bottom line is that the ACLU HAS no principles. It simply is PRO-Nazi, Pro-KKK, Pro-Islamic Terrorist, etc. The main principle they have, if you can call it that, is that they take great pride in defending the “rights” of criminals, scumbags, degenerates, and other assorted lowlifes. This may seem an extreme point of view, but extreme as it is, I don’t think it’s off base.

Ralph Adamo on February 28, 2012 at 3:06 pm

So much “justice” in this country depends on your choice of lawyer and the luck of the draw on who the judge will be. And let’s not forget the jury of 12 of your peers and how unpredictable that can be.

This case is just another example that justice is not blind.

fred on February 24, 2012 at 9:12 am

Ummm, what’s a muslim family doing at a Halloween parade? That muslim father would be stoned to death in a muslim country for exposing his family to such debauchery. Why didn’t the judge point that out!? I wonder what this guy would have done if someone was dressed as Jesus with a sign reading ‘Son of God’. That would probably be considered insulting to islam as well.

Miranda Rose Smith on February 26, 2012 at 7:42 am

Can’t he appeal? If the judges ruling was wrong, surely it will be overturned! And then this guy should sue the incompetent judge (if that is allowed).

Karen on February 24, 2012 at 9:43 am

Sounds like judicial misconduct to me. I don’t know what the recourse is in Pennsylvania, but he should be dismissed or voted out. He’s got no business being on the bench.

Raymond in DC on February 24, 2012 at 10:04 am

To complain and to appeal,if I am in that situation it all takes time and money, most of the time we chose the easiest way,and prolly this will be the case here,if faced with an expensive legal bill most of us would just take it bc there is no legal fund to dip into and that how judges at different venues set precedents,in this case it clearly illustrates yet again how these vermints are slowly and little by little invading our country, sadly most of our neighbors are either ignorant or indifferent to see the threat, which as a result makes us look as the “mean ones” and our options to protect and defend our nation are very limited or non existent, that s where we are at this point……Damn all mooooooslems and their stupid un holy satanic koran….I spit and step on their satanic prophet mohamed.

Juan on February 24, 2012 at 10:28 am

Judge Martin stated “I think I know a little bit about the faith of Islam. In fact I have a copy of the Koran here…”

I wonder when that sharia loving judge will start swearing people in on that book instead of the Bible?

I also wonder if it would be OK with that judge if I knocked the sh#t out of some muslims burning the American flag? I challenge the judge to show me in our American Constitution where there is a right to burn our colors.

I would gladly contribute money to Mr. Perce’s defense fund were he to appeal. And he should appeal. The judge in this case has no business sitting on any bench; he is a disgrace to the judiciary.

As an aside, I’ve often wondered about Joe Farah. He’s a well-known figure among conservative wonks/journalists. He and his contributors at World Net Daily pass themselves off as hard-nosed, shoe-leather investigative reporters, yet they seem to have few, if any, inhibitions about ripping off others’ work. Which makes sense. Back in 2000 they hired Paul Sperry, who by then earned a reputation as a serial plagiarist, to run WND’s Washington bureau.

What’s with Farah anyway?

S: Spot on. Sperry, who trolls this site for stuff to steal, stole many columns from this site, including at least a good part of a chapter for “his” book, “Infiltration.” It was like me re-reading what I originally wrote, which he ripped off. The guy is a major thief and schmuck. DS

Seek on February 24, 2012 at 12:19 pm

Real journalists do original reporting and they credit their sources. They have integrity and can stand by their work, which they earned.

The folks at WND are a disgrace to journalism. Nothing written there is believable. Nearly every one of their stories is either ripped off or stolen from others without proper attribution or acknowledgment.

They’re not the only ones who do this by any means but they are the worst offenders in the journalistic community. Debbie used to write a column for them but left after she witnessed what they actually do.

And she’s just waiting for Aaron Klein to rip off word for word, today’s post!

NormanF on February 24, 2012 at 1:55 pm

How do we get letters and e-mails to the appropriate people to protest Martin’s insane ruling, and question his right to remain on the bench? Obviously, he has less understanding of the boundaries of the 1st Amendment than my 8 year old son, and his calling a victim of assault a “doofus” shows significant impairment in judicial temperament.

First off, WTF are we appointing muslim judges in this country? Don’t they know that if you appoint a muslim judge to the bench, he or she will NOT acknowledge US laws and try to force sharia/islamic law on the plaintiff and defendants in the courtroom (Debbie, you’re an attorney you know more about this than I do maam, and the samething can be said for our pal Jonathan E. Grant).

What that atheist did was practice his first amendment rights, last I checked, we STILL live in the UNITED STATES of AMERICA, NOT Iran, Syria, Lebanon, Egypt, Libya, Saudi Arabia, Jordan, Gaza, West Bank, etc. And I think our other pal “Drakken” was right, there is no such thing as a patriotic muslim, I’m beginning to agree with him more and more when I hear and read stories like this, when intolerant muslims in this country REFUSE to accept other peoples point of view!

If these freaking muslims in this country who doesn’t like us criticizing their cult-like religion or do a satire of their prophet who was a pedophile, child rapist, war-mongeror, etc., then they can pack up their bags and go back to the middle east where they came from and/or belong, because I AM SICK AND TIRED OF US DOING THIS F**KING PANDERING TO THESE MOTHERF**KING THROWBACKS WHO’S MINDSET IS STUCK IN THE 7TH CENTURY (forgive me for using the cap-locks, I use them whenever I’m pissed off and annoyed).

    Hey Right is always Wrong:

Some muslims are scary. That muslim who “harassed” the atheist in the Mohammed Zombie costume crossed the line. He was not civilized. He took it upon himself to aggressively defend the prophet Mohammed by trying to take the atheist’s costume and sign off of him and interfering with the atheist’s freedom of expression in a parade. In court the muslim vigilante lied about having physical contact with the atheist and any impartial listener to the entire case knew it. But the judge wasn’t impartial. Does a judge who should be impartial and isn’t scare you? How do women fare in that muslim judge’s courtroom? How do devout believers of religions other than Islam fare in that judge’s courtroom? Hopefully, that judge will lose his job soon so we don’t find out how unfairly he might treat women and other non-muslims.

So, I did not know that the atheist mentioned in this story was some sort of right wing nut. Please tell where you got that information. Also, do you think it was proper of Judge Martin to dismiss an assault case because the defendant was a Muslim? Would you like to actually defend that position, rather than engage in a rant worthy of an eight year old?

By the way, you might try asking what Judge Martin thinks of homosexuality. On this site, gays will get some criticism for their actions. Judge Martin, if he were being an honest Muslim, would have to state the Islamic position on gays plainly. I rather doubt that you would like what he had to say on the subject. It would indeed be a matter of life and death in his eyes.

WTF are you saying, that this secular person should have never mocked and ridicule Muhammed? Are you saying that he should be imprisoned for mocking Muhammed? If you say yes to that answer, then you are a freaking cryto-fascist you left wing scumbag.

I also bet if the islamist take and try to impose sharia law upon us, you’ll more likely take their side and round up everybody in this country who’s non-muslim/infidel. WAKE. THE. HELL up dumbass, and quit making excuses and bending you’re ass backwards for islam and muslims. BTW since you’ve once again did “The Boy Who Cried Wolf” and used the word racist, what race is islam dumbass?

And BTW, I and everybody on this blog don’t have NOTHING against LGBT people, and one of Debbie’s relative is homosexual, so think before you say something, it makes you look ultra stupid. One more thing before I go, do you know what happens to LGBT people in muslim countries in the middle east and southeast asia? LGBT people in those countries are either killed, oppressed, imprisoned, etc. because of their sexual orientation, but then again, you live in you’re own isolated world of utopia far-leftism and sing “kumbaya” with those who want to take you’re life. And if you pass away anytime in the future, I will NOT shed any tears for you dumbass!

Was judge Martin correct in dismissing a case against a Muslim defendant who had choked another man, even though the Muslim defendant admitted to the offense? Also, was it appropriate for a judge to give the victim a lecture on the glories of Islam? Are you up to answering that, or are you going to continue to act like an eight year old? Are you afraid to give a coherent answer, or just incapable of it?

pat on February 24, 2012 at 1:29 pm

Agree about judicial misconduct.

A judge is not supposed to take bribes, show favoritism or to subvert justice.

Judge Martin openly favored someone of his own religion – well cuz that’s what Muslims do.

I would have actually been shocked if he had behaved as a judge.

Make no mistake though – applying Sharia means the end of equality under US law and every freedom we’ve ever taken for granted.

There are reasons we want to stop it and it has nothing to do with Islamphobia. Its exactly the opposite.

NormanF on February 24, 2012 at 1:39 pm

While it would be nice if there could be an appeal, I am assuming this was a criminal trial therefore there can be no appeal (Double Jeopardy).

I_AM_ME on February 24, 2012 at 1:57 pm

I agree that this ruling sounds like a lot of BS. But I have never had any inkling that Judge Martin is a muslim. He is a former policeman in Mechanicsburg who was elected around 2005 for a six year term (and reelected last year). There are almost no muslims in his district (although that may be changing, as a couple of small mosques have sprung up in the area). I don’t know where the atheist organization got their information, but it would surprise me very much if Martin is an actual muslim. He probably received a lot of “sensitivity training” during his tours of duty with the military. I think the real lesson is that non-muslims better wake up and stop letting Islam bully them.

I wonder how this would have been treated if a Catholic had attacked the zombie pope in that parade.

salt1907 on February 24, 2012 at 2:39 pm

This is precisely why voter propositions like the one in OK were needed, and which were overturned by activist judges. Now you have activist judges implementing Shariah, which is a logical extension of SCOTUS justices saying that foreign law was a legitimate basis on which to try cases in the US.

What I do wonder is whether American Atheists can rally behind Mr Perce this time, since their adversaries ain’t the Christian Right or the ‘neo-Cons’, but Muslims. If they can, they deserve the support of everyone who has a clue about what Muslims are about. But if they can’t, count this one too as one more of those Alien vs Predator moves, even though I typically would support anyone, including hostile Space Aliens, against Muslims.

I saw this news over at Volokh Conspiracy blog by Eugene Volokh this morning before I saw this one. That blog included a link to a YouTube piece of the trial. Volokh thought the Muslim-sympathetic judge’s dismissal of the victim was out of place with his ruling.

Judge Martin is absolutely wrong about the First Amendment and his dismissal prove his gross ignorance of it. He should be disbarred or impeached from his position. No American judge should be Muslim if he/she allows sharia and Islamic laws to take precedence over American laws.

Bob on February 24, 2012 at 5:16 pm

Judge Martin, actually a district justice, said in the audio tape that he is a Muslim. By the way, the judge was a member of the Army Reserve in 2008 and was deployed to Iraq. District Justices are elected in Pennsylvania, so he will stand for election in a conservative area of Pennsylvania. The PA Supreme Court will not remove him from the bench. Although I feel for the atheist, he and his type have progressively undermined the Judeo-Christian culture and heritage of this country. They think that a secularist utopia will be ushered in, but what will take its place is leviathan government and Islam.

Concerned Citizen on February 24, 2012 at 6:50 pm

Debbie, why do you have the strikeout over Shariah, when in fact, the strike-out should be over the bill of rights, and its replacement by Shariah? Or better still, a couple of (Saudi styled) Islamic swords overlaid on a representation of the US constitution

Infidel on February 24, 2012 at 11:23 pm

The judge’s arguments are so breath-takingly wrong that I thought there must be something missing from the story. I am not familiar with the jurisdiction, but I have some questions: 1.) Was this case dismissed BEFORE trial on a motion by the defense? And if so, what was the motion and why would the victim (who after all is a witness and not the prosecuting body)have been present? 2.) If it was a criminal trial, how come there wasn’t a jury, especially if the trier of fact (the judge) is a Muslim? 3.) If the judge is a Muslim, why didn’t the prosecuting authority file an affidavit of prejudice against the judge. Or, 4.) was the Muslim assailant cited by the police with a low level, fine only violation (akin to a traffic ticket) and it was a “direct filing” by the police agency, so that no prosecuting agency was present and no jury was permitted.

If the fine people of that area of Pennsylvania do not vote Judge Martin out of office when he comes up for re-election, then they get the justice they deserve.

We are hopeless. I just pray that our future Chinese overlords can clean the mess up.

gmartinz on February 25, 2012 at 11:07 am

Definitely worth reading,

Mechanicsburg Penna is in very red part of the state, Cumberland County, eight miles west of Harrisburg, about a two hour drive from my condo in southeast Penna.

This is a most extraordinary case; the First Amendment is undermined by Sharia compliant judge.

It should be noted that the atheist was mocking Christianity and I don’t think I have even seen a reference to that. It seems Christians, like Jews, have accepted this kind of childish and simple-minded mockery of deeply held beliefs by those who do not know or do not want to know the depth and breadth of the spiritual meaning found in Torah.

Separately, what is so hard about crediting another post. Hat Tips are common in blogging and, many times, the blogger is disseminating information to a group with whom she has established credibility. There are many other sources of good information, including the indispensable DS, so we don’t have to read WND. Too bad. I liked what it did.

Concerned Citizen, you are spot-on. This is what happening in this country now and in the future. The anti-Judeo-Christian atheists are precisely doing that, but they are useful idiots by the powers-that-be with vested interests in destroying the constitutional foundations of the country and replacing it with a new secular-liberal constitution, but that one would eventually be set up for a big failure and perhaps be replaced with Islam by a growing Muslim population in the USA.

Hagman had his apparent lawyer at the time Jack Thompson send DMCA violation quotations to those who published the actual work PRIOR to it being ripped off by his [Thompson’s] client(s). wtf??
Funny thing, it’s as if Premiere Radio Network, Clear Channel Communication, WND, Cunningham, and others have a Memorandum of Understanding between all of them; everyone is interviewed on each others shows/”news” outlets etc. Hmm… a sort of “playlist” of sorts…
Stay hard Deb. Stay hard.

I would like to see a bunch of non muslims dress up in full burqa? outfits with only the eye slits and pace back and forth in front of this distric justices’ house and see if he would do anything about it. They could also do their regular routines, such as, going to the gas station, liquor store, banks shopping centers in full burga halloween costumes.

District Judge Mark Martin’s rational for the dismissal of this case betrays a profound lack of understanding regarding the 1st Amendment; this combined with his unprofessional and inflammatory commentary speaks volumes about his unsuitability to serve in a position of trust in any U.S. court–he should be removed from the bench forthwith.
