Victory: Schlussel Court Win-Loss Record Intact – Defending Hard-Working Americans (Who Escaped Muslim Persecution) Against Nuisance Suits

Just got back from court, where my string of victories remains intact.  I successfully defended clients and friends of mine who own the gym where I work out, against a ridiculous nuisance lawsuit.  It’s the kind of case that epitomizes liberalism–trying to get something for nothing out of the pockets of hard-working Americans.

My clients/friends are great people, and are like brothers to me.  I’ve known them and their families for many years.  They are Chaldeans–Iraqi Catholics, who were born in Iraq, but came here to escape Muslim extremism.  Their father owned a bar, and one day, Muslims came to the bar, seized it, and shut it down because alcohol consumption violates Islam.  He saw the handwriting on the wall and moved his wife and 11 kids to America, where they worked hard and built businesses.  Now, some of the sons have a fantastic gym.  A member apparently wanted a free pay day and claimed that hundreds of dollars were stolen from his jeans pocket in his locker (while he still had his wallet and credit cards because those were–conveniently–“left in his car”).  There was no evidence, no broken lock, no dents in the locker, plus he signed a waiver absolving the gym of responsibility for lost or stolen property.  Case closed.  I love going to court and winning cases like this.

Before the case was heard, I watched as several criminal defendants got arraigned.  One of them was a 46-year-old with a string of crimes and civil infractions.  He was in prison for two years, and upon his release, immediately committed larceny, stealing baby formula so he could trade it for heroin, to which he’s addicted.  Apparently, baby formula is the “currency of choice” in the heroin market (according to the Judge), which interests me, since it’s also the “currency of choice” for some Islamic terrorist financiers, who launder money here to send “back home” for martyrdom.  This man stated that he had six kids (but didn’t say from how many mothers, which I was interested to find out–I’ll bet multiple ones).  Six kids who have a repeat offender for a dad, who will probably turn out like he did.  And you wonder why America is faltering.  There are plenty like this guy.  Very sad for this country, and it’s yet another of many rips in the fabric that was once America.

Anyway, I won my case, and I’m proud.  I hate these nuisance cases, which are nothing more than a multi-billion dollar tax on America.  My gym owner had to spend three hours traveling to, waiting for, and then having his case heard in court.  And every time a business gets sued by some “rent seeker” like this, it costs us all.  It’s added to our bottom  line.

Congratulations on your victory. In most gyms, members also have the option of leaving their valuables at the desk while they are working out. Hopefully none of those six kids will turn out to be judges.

Way to go, Debbie! (I’m pleased to hear that there’s yet another defeat of the would-be shakedown artists!) (read an article in today’s National Post that Ezra Levant and some others — bloggers — may not be faring quite so well…due to Canadian laws here…real drag…very little protection for Free Speech, since unlike Americans we have no First Amendment — human “rights” people here in Canada have been quoted as claiming that Free Speech is one of those “American values;” and apparently, something which can be dispensed with…)

Debbie, Congratulations. Your blog is so thorough, it easy to forget that you are a working lawyer on top of that. May God continue to bless you with legal and intellectual skills. Chaldean’s have such a fascinating history or faith and persecution. I am glad this family had a friend like you to help them out, but it also makes me sad for the persecuted around the world who do not have a chance at justice.

Great that the nice guy won, but it illustrates the way our system is wrong. The so called “winner” still has to pay legal fees and time off work etc, while the “loser” suffers no consequences. Until the courts go with a loser-pays plan, this will continue and ambulance chasers (not you DS) will thrive.

I like sitting in court and hearing other cases while waiting for mine. It is amazing, funny and stupid all at once.

At one a guy was going to have his pay garnished and had to show the judge his pay stub. So he hands it to the bailiff and then says “only half of that amount is mine”. The judge asks why? He replies “when I cash it I share half with Manny so he gets his pay too”. So now I am thinking we got ID, ssn, fraud, illegal aliens and its going to get interesting. Nope, the judge tells him to tell his boss to find another way to pay Manny as his pay check is going to be looked at. Next.

Couldn’t believe it. Yep spend a day in a court room and you will learn real quick why this Nation is in trouble.

It was a good win for you. it is really amazing that a court would even entertained this suit, since a waiver had been signed by the plaintiff.

    Courts are tools to be used and abused as I have discovered when I tried to help a Moslem lady named Souad who helped my mom find justice in Deabornistan where even the judge she was assigned was under attack for critisizing Fordson high school at a dinner.
    This dear lady was cheated on a nosejob by a doctor Haitham Masri whose daughter Lena is suing Debbie on behalf of CAIR a “momzer” organization made up of Quisling apologists and so called “good” Imams with ulterior motives such as supporting Hezbollah, and welcoming ant-semetic bigots (birds of a feather) to their mosques such as Louis Farakhan. The “good doctor”Masri who had his license suspended for falsifying records after he damaged this guy also calls for a boycott of Starbucks.
